§ 36.21  FIRE CHIEF; ASSISTANT FIRE CHIEF; MEMBERS.
   (A)   The positions of Fire Chief and Assistant Fire Chief are hereby established. In addition, the Department shall consist of full-time personnel and volunteer members as determined by the Mayor and City Council.
   (B)   The positions of Fire Chief and Assistant Fire Chief shall be filled by appointment of the Mayor.
   (C)   The Fire Department shall operate pursuant to rules and regulations promulgated by the Fire Department and approved by the Mayor and City Council.
   (D)   Office of Fire Chief.
      (1)   The powers and duties of this office are hereby established as those contained or set forth in the Kentucky Revised Statues and those included in the position description of the city’s classification plan (as adopted in § 137.01), and related duties as requested or assigned.
      (2)   The oath of office to be executed by the Fire Chief shall be that as set forth in Section 228 of the Constitution of the Commonwealth of Kentucky.
      (3)   Compensation for this office shall be included in the city’s compensation plan.
      (4)   The personnel policies and procedures of the city shall apply to this office.
