1325.01 FENCING REQUIRED.
   (a)   Every outdoor swimming pool or family swimming pool shall be completely surrounded by a fence or wall not less than four feet in height, which fence shall be constructed as not to have openings, holes or gaps larger than four inches in any dimension except for doors or gates; and if a picket fence is erected and maintained around such pool, the horizontal dimension shall not exceed four inches. A dwelling house or accessory building may be used as a part of such enclosure.
   (b)   All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times when not in actual use, except that the door of any dwelling house or accessory building which forms a part of the enclosure be not so equipped.
   (c)   The requirements of this chapter shall be applicable to all new private swimming pools or family pool hereafter constructed other than indoor pools, and shall apply to all pools now in existence which have a minimum depth of eighteen inches of water. No person or firm in the possession of land within the Village, either as owner, purchaser, lessee, tenant or licensee upon which is situated a swimming pool or family pool having a depth of eighteen inches shall fail to provide and maintain such fence or wall as herein provided.
   (d)   The Wayne County Health Department may make modification in individual cases with reference to this chapter upon showing of good cause to said department with respect to the height, nature or location of the fence, wall, gate or latches or the necessity thereof, provided that the protection as sought hereunder is not reduced thereby.
