1343.08 PENALTIES.

   (a)   Any person failing to comply with a notice of violation or order issued in pursuant to this Chapter shall be deemed liable for a civil infraction as follows:

      (1)   If a notice or order is not complied with within thirty (30) days, a two hundred fifty dollar ($250.00) fine will be assessed.

      (2)   If a second notice or order for the same violation within a one (1) year period is not complied with within thirty (30) days, a five hundred dollar ($500.00) fine will be assessed.

   (b)   If a third notice or order for the same violation within a one (1) year period is not complied with within thirty (30) days of the notice, the violator will be charged with a first degree misdemeanor and/or a one thousand dollar ($1,000.00) fine will be assessed.

   (c)   The time restraints may be modified by the Building and Zoning Administrator or designee due to inclement weather or type of violation.

   (d)   Fines can be suspended if the owner(s) submit a plan to the Building and Zoning Department within thirty (30) days to actively market the property to sell and a maximum of twelve (12) months on the market to have the property sold.
