939.03 COSTS AND CHARGES.
(a) The City shall also charge all reasonable costs and charges associated with each attachment or pole attachment, including but not limited to, costs for pole replacement or repairs to poles necessitated by age, deterioration, accident, need to accommodate additional attachments, or other occurrence(s) or need to keep the poles, attachments, or right of ways, streets, alleys, or easements in a safe, efficient, and workmanlike shape for the safe use of the facilities and right of ways, streets, alleys, or easements within the City of Dover. These charges do include the right of the City to replace poles as deemed necessary, solely within the discretion of the City, and then to assess said charges on a pro rata basis to each entity that has an attachment to said pole or facility. Said charges shall be made and sent to the entity that attaches to the pole or facility and paid within 60 days or July 1, whichever comes sooner.
(b) In the event that any entity that owns poles or other facility that the City attaches a City electric, fiber, or other device including a communication device or line to, and the entity charges the city a higher charge than stated herein for an equivalent attachment, the City shall charge a reciprocal charge to that entity for its attachment(s) to city poles equal to the charge assessed to the City.
