1322.01 REQUIREMENTS.
(a) Fences up to three feet in height are permitted in yards fronting on the public street. The building line of the house foundation shall be considered as the point from which a fence may extend toward a front property line not to exceed three feet in height, and on a corner lot a fence shall not protrude beyond the building line of a structure in a side yard in excess of three feet. Fences in a front yard must stay a minimum of twelve inches back from a sidewalk, if present. These same screening devices up to six feet in height are permitted in the remaining yards. In the event that a request is made to install a fence in excess of three feet on a corner lot that abuts a rear alley, it shall be the discretion of the Building and Zoning Codes Administrator to determine where the fence shall be located and at what height it shall be allowed in order to create a reasonable visibility for vehicular traffic where two right of ways intersect. No fence shall be permitted to be erected in a City easement or in a right of way. Chain link fencing shall only be permitted in the side and rear yards in residential districts. It's the responsibility of the property owner to ensure that any fence is installed within the confines of their property. In no case shall a fence prevent an adjacent property owner from performing maintenance to any structure(s) on their property. Fences shall present a finished side to the adjoining property, which side shall not be adorned with signs, graphics or paintings of any kind. Any fence that is installed in the City shall be suitable and designed for the intended purpose by the manufacturer and shall not be made of makeshift materials. Construction site or snow fences are permitted only on construction sites during the period of work performed at that location. All fences erected in the City of Dover require a twenty-five dollars ($25.00) zoning certificate fee, accompanied by a drawing and filed with the City of Dover Building and Zoning Administrator. (b) Any private swimming pool that is defined in Section 1143.09 Private Swimming Pools shall adhere to the fencing provision under Section 1143.09(b)(3). The swimming pool, or the entire property on which it is located, shall be walled or fenced to prevent uncontrolled access by young children from the street or from adjacent properties. Such fence or wall shall be not less than four feet in height and maintained in good condition, with a gate and lock. Alternately, the swimming pool may be constructed or situated in such a way that there is no less than a four foot barrier, deck, rigid side or other construction that is equivalent to a fence or barrier that has a four foot height.
(c) No person shall erect or maintain any fence charged with electric current, or maintain a barbed wire fence which abuts or is adjacent to any public street or sidewalk. Injurious materials such as barbed wire or spiked fences are not permitted, except in the placement and use of not more than three strands of barbed wire on top of a fence other than a barbed wire fence, provided such strands are not less than seventy-two inches from the ground. Such fence may only be located in a Commercial (B) or Industrial (M) zoned district. Whoever violates this section is guilty of a minor misdemeanor. Penalty, see 501.99.
(d) Off-street parking areas for more than ten vehicles shall be effectively screened on each side which adjoins or faces premises situated in any residential zoned district, or institutional premises by a masonry wall or solid fence of acceptable design. Such wall or fence shall not be less than four feet or more than six feet in height and shall be maintained in good condition without any advertising thereon.
(e) Auto and metal salvage operations shall be effectively screened on all sides by means of walls or fences. Walls or fences shall be a minimum of six feet in height and a maximum of eight feet in height with no advertising thereon and properly maintained. Fences are permitted to have barbed wire across the top for security purposes in the M-2 zoned (General Industrial) districts. (Ord. 35-17. Passed 11-20-17.)
