1355.05 NONCOMPLIANCE WITH NOTICE
   (a)    Whenever the owner, agent, occupant or operator of a structure or premises fails, neglects or refuses to comply with any notice of the Building and Zoning Codes Administrator and/or Codes Supervisor, the Building and Zoning Codes Administrator and/or Codes Supervisor may issue a notice to such owner, agent, occupant or operator ordering the structure or premises, or part thereof, to be vacated, or he may advise the City Law Director of the circumstances and request the Law Director to institute an appropriate action at law to compel compliance, or both.
   (b)    Whenever the owner, agent, operator or occupant of a structure or premises fails, neglects or refuses to comply with a notice to vacate issued by the Building and Zoning Codes Administrator and/or Codes Supervisor, the Building and Zoning Codes Administrator and/or Codes Supervisor may request the Mayor to enforce the orders of such notice of vacation and cause the structure or premises, or part thereof, to be vacated in accordance with the terms of such notice.
   (c)    Whenever the owner of a building or structure fails, neglects or refuses to comply with a notice and order to repair or demolish such structure or part or appurtenance thereof, issued by the Building and Zoning Codes Administrator and/or Codes Supervisor in accordance with the provisions of this Housing Code, and when such building or structure is determined by the Building and Zoning Codes Administrator and/or Codes Supervisor to constitute a public nuisance injurious to the public health, safety or welfare, the Building and Zoning Codes Administrator and/or Codes Supervisor shall request the Law Director to prepare and submit to Council appropriate legislation stating the determination that the building or structure in question is a public nuisance and authorizing the Mayor or Safety Director to enter into contract for demolition of such building or structure or parts thereof, or to take such other action as may be necessary to abate the nuisance. The Clerk of Council shall be authorized to certify the costs of the demolition or other action to the County Auditor to be assessed as a lien against the affected real estate according to law.
