1327.02 MINIMUM SPACE, USE AND LOCATION REQUIREMENTS.
No person shall occupy as tenant or as owner-occupant or let to another for occupancy any dwelling or dwelling unit, for the purpose of living, sleeping, cooking or eating therein, which does not comply with the following requirements:
(a) Space.
(1) Calculation of floor space. Floor area shall be calculated on the basis of habitable room area. However, closet area and hall area within the dwelling unit, where provided, may count for not more than five percent of the required habitable floor space. At least one-half of the floor area of every habitable room shall have a ceiling height of at least seven feet. The floor area of that part of any room where ceiling height is less than five feet shall not be considered as part of the floor area in computing the total floor area of the room for the purpose of determining the maximum permissible occupancy thereof.
(2) Habitable floor space.
A. Every dwelling unit shall contain at least 150 square feet of floor space for the first occupant thereof and at least 100 additional square feet of floor space for each additional occupant.
B. In every dwelling unit of two or more rooms, every room occupied for sleeping purposes by one occupant shall contain at least seventy square feet of floor space for the first occupant and every room occupied for sleeping purposes by more than one occupant shall contain at least fifty square feet of floor space for each occupant thereof.
(b) Arrangement of Habitable Rooms. No dwelling or dwelling unit containing two or more sleeping rooms shall have such room arrangement that access to a bathroom or flush water closet compartment intended for use by occupants of more than one sleeping room can be had only by going through another sleeping room. Nor shall room arrangements be such that access to a sleeping room, a bathroom or flush water closet compartment. This requirement can be waived at the discretion of the Coordinator.
(c) Location of Dwelling Units; Basement or Cellar. No basement or cellar shall be used for living purposes unless:
(1) The floors and walls are substantially watertight.
(2) All requirements of this Code are met as regards to light, heat, ventilation and ceiling height.
(3) Nonliving space in the basement is permanently separated from all habitable space.
