1324.01 FIRST FLOOR HEIGHT.
   (a)    Any person, corporation, partnership or association constructing or altering a building or an addition to a building shall establish the first floor level of the building at a minimum height above the back of the existing sidewalk, or planned sidewalk if no walk exists, conforming to the following requirements:
      (1)    Front yard requirement of zero feet - first floor height shall be the same as back of sidewalk height.
      (2)    Front yard requirement between zero feet and thirty feet - first floor height shall increase one inch in height for each foot the building is set back of the property side of the sidewalk.
      (3)    Front yard requirement beyond thirty feet - the first floor height shall be thirty inches in height plus one-fourth of an inch in height for each foot over thirty feet that the building is set back of the property side of the sidewalk.
   (b)    Any person, corporation, partnership or association constructing or altering a building or an addition to a building, which building is considered an accessory building to the principal building occupying the premises, like a garage or storage building, shall establish the first floor of the accessory building in such a manner that positive drainage is maintained from the building or adjacent street, alley or natural draining surfaces.
   (c)    The Planning Commission shall, in accordance with its rules of procedure, have authority to investigate and grant variances of any of the provisions contained in this chapter in the event of hardship or impossibility of compliance with the specific terms hereof.
