1323.07 EROSION CONTROL.
   (a)    Whenever the surface of a lot or plot or any land in the City is excavated, filled, graded or stripped of its vegetation, positive erosion control shall be provided by erecting a barricade of straw bales in such a manner that no soil or debris escapes from the lot, plot or land onto the streets or into the City storm sewer system.
   (b)    If soil or debris escapes into the City storm sewer system, the entity responsible for such, which is deemed to be the entity who received a permit for the related construction which caused the need for erosion control, shall immediately remove all soil or debris from the streets or storm sewers. Failure to remove such soil and debris will cause the City to have the soil and debris removed from the streets and/or storm sewers. The cost of the removal shall then be invoiced to the entity who received a permit for the related construction work. Failure to pay the removal costs will cause the City to place such costs on the County Property Tax Duplicate for collection. (Ord. 12-91. Passed 4-15-91.)
