929.05 EXEMPTIONS.
(a) Any person, firm, partnership or corporation may annually refuse receipt of the collection service provided they have made alternate provisions for the adequate disposal of garbage and refuse. On or before January 15 of each year, any person, firm, partnership or corporation desiring not to receive collection service from the City for that year shall file with the Director of Public Utilities a sworn affidavit on a form to be provided by the Director. Such affidavit shall be notarized and shall include the following information:
(1) The location at which service is not desired.
(2) The alternate method to be used for the disposal of garbage and refuse.
(3) The name of any commercial hauler with whom the affiant has contracted for service for that year.
(4) The name of anyone other than the occupant who will be removing garbage and refuse from the premises.
(b) Failure to annually file the aforementioned affidavit or after the filing of such affidavit, the failure to make alternate provisions for the adequate disposal of garbage and refuse, shall result in a charge for trash collection to be assessed against such person, firm, partnership or corporation without regard to whether the service of the City is used.
(c) The exemptions granted pursuant to this section shall remain in effect for the year in which such application is filed. Applications to renew such exemption must be filed annually. (Ord. 52-83. Passed 9-6-83.)
