901.01 PAVING ALLEYS.
   (a)    (1)    On petition by owners of lots or land abutting upon any public alley, the City may pave such alley with ODOT 404 or other suitable paving material, such paving not to be in excess of sixteen feet in width and to a depth of not less than three inches.
(2)    No alley shall be paved by the City under this section until there is paid in cash, to the City by such abutting property owners, a sum equal to the estimated cost to the City for such paving.

   (b)    In addition to the above method of alley paving, City Council may, pursuant to an alley paving program and upon a finding that the paving of any alley is necessary for the preservation of the health and safety of the residents of the City, authorize the Director of Public Service to pave any alley designated by Council at the cost of the City.
