549.07 OVERHANGING BRANCHES TO BE TRIMMED AND NOTICE TO PROPERTY OWNERS.
(a) The overhanging branches of any and all trees, bushes, shrubs or ornamental plants on the streets, alleys or sidewalks of the City, which interfere with the lighting of the streets and sidewalks or in any way interfere with the passage of pedestrians along the sidewalk or which in any way interfere with or block the view of traffic control signs by the traveling public, or which in any way interfere with or block the travel of motor vehicles on the alleys or streets of the City, shall be trimmed and kept trimmed to a height of at least ten feet above the streets and sidewalks out of the public right of way.
(b) No owners, agent, lessee or tenant having charge or control of any real estate in the City, shall allow or permit the branches of any tree, bush, shrub or ornamental plant standing on the street or lawn strip in front of his premises or along any alley bordering his premises to overhang the street, sidewalk or alley in such a manner as to interfere with the lighting of the same or to interfere, obstruct or discommode in any manner the passage of pedestrians along the sidewalk, or to interfere with or block the view of traffic control signs by the traveling public, or to interfere with or block the travel of motor vehicles within any alley or street. Any such condition and obstruction is declared to be a nuisance.
(c) The Director of Public Service shall cause a written notice to be served upon the owner, lessee, agent or tenant having charge of any land, notifying him that he is in violation of this section and that the overhanging branches shall be trimmed according to the specifications of the Shade Tree Commission within five days after the service of notice.
