549.06 ABUSE, MUTILATION OR REMOVAL OF TREES.
   (a)    No person, firm or corporation without a permit from the Director of Public Service shall damage, cut, carve, girdle, climb, kill, remove, transplant, injure, or break any tree or portion of a tree; attach any rope, wire, nails, advertising posters, or other contrivance to any tree or portion of tree; allow any gas, liquid, or solid substance which is harmful to trees to come in contact with them; or set fire or allow any fire to burn when such fire or the heat thereof will injure any portion of any tree. Such regulations apply to any and all trees growing on the public way, curb strips, streets, alley or Municipal property.

   (b)    Any person, firm or corporation desiring for any lawful purpose to cut, prune, treat with a view to its preservation from a disease and insects, trim or repair any tree in any public way, curb strip, street, alley or Municipal property may apply to the Director of Public Service for a written permit. If, in the judgment of the Director, the desired cutting, pruning, treatment or trimming appears necessary and the proposed method and workmanship thereof meets the specifications of the Shade Tree Commission, and provided that the owner of the premises in front of which the tree or trees are located approves, the Director may issue a written permit for the work. Any such permit shall be granted on condition that the work to be done shall be in accordance with current National Arborist Association standards for shade trees. Any work done under the permit must be performed in strict accordance thereof. The Director of Public Service shall refer an application for removal of a tree in the public way, curb strips, street, alley or Municipal property to the Shade Tree Commission and may deny such application if the tree is not recommended for removal by the Commission.
