3-23-3: PROHIBITED CONDUCT:
Prohibited conduct at Heritage Crossing includes behavior, conduct or activity at Heritage Crossing that violates any federal, state or local law, ordinance rule or regulations, and including, but not limited to, the following:
   (A)   No person shall be in Heritage Crossing during hours of closure. This subsection (A) shall not apply to pedestrians crossing Heritage Crossing between two adjacent sidewalks or persons attending, participating in, going to or coming from an activity programmed or scheduled by the city or by the Dixon Chamber of Commerce and Main Street.
   (B)   No person shall use obscene or abusive language or gestures, or threaten violence or injury to the person or property of others, in a manner intended and likely to incite or produce an immediate breach of the peace or violent or disorderly response.
   (C)   No person shall make or cause to be made any excessively or unusually loud noise in violation of section 4-7-7 of this code. No person shall play or operate any sound amplification device including radios, television sets, turn tables, CD players, cell phones, public address systems, amplified musical instruments, portable speakers or generators or any other loud noise generating device. This section shall not apply to the playing of any music instrument, public speaking, or the amplification thereof, in conjunction with an activity programmed or scheduled by the city or by the Dixon Chamber of Commerce and Main Street.
   (D)   Smoking or any use of a tobacco product is prohibited at Heritage Crossing, except at locations designated by the city. For purposes of this subsection (D), smoking and tobacco are defined to include, but are not limited to, cigarettes, cigarillos, cigars, clove cigarettes, e-cigarettes, nicotine vaporizers, nicotine liquids, hookahs, pipes, chew, snuff, smokeless tobacco, and cannabis.
   (E)   No person shall climb any tree, monument or statue, or walk, stand, sit or lie upon the monuments, statues, railings, fences, wall, and masonry columns.
   (F)   No person shall utilize the personal property, fixtures and equipment of the city, including all chairs, benches and tables, in any manner other than for the purpose for which they are designed and customarily used. No person shall stand upon any chairs, benches or tables or sit or lie on the top of any table or on the back of any chair or bench.
   (G)   No person shall take, remove, destroy, break, cut, injure, mutilate, or deface in any way, or attach anything to, any structure, monument, statue, fountain, wall, fence, railing, chair, bench, table or any other personal property, fixtures or equipment of the city. No chair, bench, table or any other personal property, fixtures or equipment shall be moved from their designated location.
   (H)   No person shall remove, destroy, break, injure, mutilate, or deface in any way any tree, shrub, fern, flower, plant or other vegetation.
   (I)   No swimming, wading or bathing in the Rock River shall be permitted from Heritage Crossing.
   (J)   No person shall deposit objects of any kind, other than human waste or toilet tissue, in the toilets or plumbing fixtures of the restrooms located within Heritage Crossing.
   (K)   No person shall utilize the electric outlets within Heritage Crossing for personal use.
   (L)   No person subject to an ejection or exclusion order shall be present within Heritage Crossing.
   (M)   No person shall unreasonably disturb or interfere with any person occupying Heritage Crossing in connection with, or participating in, any activity programmed or scheduled by the city or by the Dixon Chamber of Commerce and Main Street. (Ord. 3169, 10-7-2019)
