If any person discharges sewage, industrial wastes or other wastes into the wastewater disposal system contrary to the provisions of this chapter, Federal or State pretreatment requirements or any order of the Village, Township, Board or POTW, such discharge is hereby declared to be a public nuisance and a nuisance per se. An action may be commenced for appropriate legal, injunctive and/or other equitable relief in the Circuit Court of the County, or an action for civil or criminal penalties in the Eaton County District Court.
