660.02  WEEDS.
   (a)   Every lot or parcel of land within the Village shall be kept free from weeds in excess of twelve inches for a minimum distance of 100 feet back from the street line and for the entire width of the lot or parcel. Lots which are greater than five acres shall be kept free from weeds in excess of twelve inches for a minimum distance equal to the road right of way.
   (b)   As used in this section, "weeds" shall be defined as all grasses, annual plants and vegetation other than trees or shrubs; provided, however, this term shall not include cultivated flowers and gardens. It shall be the duty of any person owning, leasing, occupying or otherwise controlling any plot of ground in the Village to prevent the excessive growth of weeds thereon.
   (c)   It shall be the responsibility of the occupant of every premises and the owner of unoccupied premises within the Village to cut and remove or destroy by lawful means all such weeds as often as may be necessary to comply with the provisions of this section.
   (d)   If any person shall fail to comply with the provisions of this section by the specified time, the Village Manager shall, through the Department of Public Works, cause all weeds to be cut or destroyed upon lands of the person not complying with the provisions of this section. The Village Council shall determine the hourly rates to be charged for the cutting of weeds. The Superintendent of the Department of Public Works shall cause the owner of property upon which the Village has cut weeds, to be billed for such services in accordance with the time spent and the rates established.
   (e)   If such charges are unpaid, the costs for weed cutting shall be certified to the Village Treasurer and the amount thereof assessed against the property on the next general assessment roll of the Village.
   (f)   The facts that weeds are cut by the Village and the cost thereof charged to or paid by the owner shall not excuse the owner from responsibility for the violation of these Codified Ordinances thereby abated. Failure to cut weeds by the owner as required in this section shall constitute a violation of these Codified Ordinances punishable as provided in Section 202.99, regardless of whether such weeds are cut subsequent to the commission of such violation.
