§ 52.01 PURPOSE AND POLICY.
   (A)   The City Council states that pursuant to the wastewater agreement between the City of Dilworth and the City of Moorhead, the City of Dilworth shall enact this subchapter.
   (B)   (1)   This subchapter sets forth uniform requirements for discharges into the City of Dilworth wastewater collection system and enables City of Dilworth and City of Moorhead to comply with all state and federal laws.
      (2)   The objectives of this subchapter are:
         (a)   To prevent the introduction of pollutants into the wastewater disposal system which will interfere with the operation of the system or the use or disposal of the sludge;
         (b)   To prevent the introduction of pollutants into the Cities of Dilworth/Moorhead wastewater disposal system which will pass through the system inadequately treated into receiving waters or the atmosphere or otherwise be incompatible with the system; and
         (c)   To improve the opportunity to recycle and reclaim wastewater and sludge from the system.
   (C)   This subchapter provides for the regulation of discharges into the Cities of Dilworth/Moorhead wastewater disposal system through the issuance of permits to certain users and through enforcement of the general requirements for the other users, authorizes monitoring and enforcement activities, requires user reporting, and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein.
   (D)   This subchapter provides for the regulation of and establishes criteria for the use of public sewers; private sewage disposal; building sewers and connections; and general discharge prohibitions.
   (E)   This subchapter provides for the regulation of industrial wastewater discharges into the Cities of Dilworth/Moorhead wastewater disposal system. Wastewater pretreatment requirements and criteria are established and defined.
   (F)   This subchapter defines the wastewater utility rate structure and user charge system and the method for calculating charges for each user classification; industrial, commercial and residential. Procedures for rate adjustments and annual rate review criteria are established.
   (G)   This subchapter provides penalties for violations of provisions of this subchapter, and the orders, rules, regulations and permits issued hereunder.
