§ 50.03 TOTES.
   (A)   Every householder, occupant and owner of any dwelling, boarding house, or any other structure utilized for dwelling purposes will be provided a 64-gallon tote for solid waste collection, and a 96-gallon tote for single-sort recycling collection by the contracted hauler. It is the responsibility of each household, occupant, and owner of any dwelling, boarding house, or any other structure utilized for dwelling purpose to properly maintain their respective tote(s). Damaged totes will be replaced by the contractor. All charges for the replacement of totes shall be between the resident and contractor.
   (B)   Any restaurant, industrial or commercial establishments, that accumulates garbage and all apartment buildings containing three or more units and schools where garbage accumulates will be required to use vat service with pickup of no less than once per week. The actual size of vat and frequency of service is to be based on need. Vats shall be of no less than one cubic yard capacity, covered, and designed with the proper attachments for lifting into rubbish trucks.
   (C)   It shall be unlawful for any person to deposit any garbage, rubbish, or waste material in any park, street, alley or any other property within the city unless such refuse is deposited in containers, the type, size and location of which are herein provided. Notwithstanding the requirements of this section, the city reserves the right to vary the type, size and location of containers required herein whenever the City of Dilworth and hauler determine its ability to sanitarily or conveniently collect and dispose of garbage, rubbish or waste material would be impaired, whenever the city determines a nuisance condition exists, or whenever the City of Dilworth and hauler determines that it would be in the public interest to do so.
   (D)   Upon request and/or evaluation of the City Staff, condominiums or similar developments may arrange for a specialized collection method. All units are still charged the regular rate as stipulated in § 34.01 of this code.
   (E)   Garbage and recycling totes must be stored within the principal structure of the dwellng, or, for exterior storage, placed neatly against either the back or side of the structure with lids fully closed, or stored in such a manner as to:
      (1)   Not create a nuisance condition; and
      (2)   Comply with all applicable setback requirements and easements.
   (F)   Solid waste and recycling and totes may be placed along the boulevard no earlier than 6:00 p.m. the day prior to collection. Solid waste and recycling totes must be removed no later than 8:00 p.m. on the day of collection.
