In accordance with M.S. § 326B.44, as it may be from time to time amended, supplemented or replaced, the city is hereby authorized to review and approve plumbing plans on new or remodeled construction projects that serve the public or that serve any considerable number of persons, said review and approval to be made in accordance with the Minnesota Plumbing Code as adopted in this chapter, as a part of the State Building Code, and in particular 7 MCAR § 1.139 Plumbing; provided, however, that the following buildings must have plumbing plans reviewed by the state rather than the city:
(A) All buildings defined by the building code as group A, B, E, F-1, I and H occupancies;
(B) All buildings defined by the building code as M occupancies that exceed two stories without a basement or one story with a basement or that contain more than 25 fixture units;
(C) All buildings defined by the building code as F-2 occupancies that exceed two stories without a basement or one story with a basement or that contain more than 25 fixture units or that contain refrigeration equipment;
(D) All buildings defined by the Building Code as R-1 and R-2 occupancies that exceed two stories without a basement or one story with a basement or that contain more than 100 fixture units;
(E) All buildings containing sprinkler systems, low pressure steam boilers, hot water boilers over 400,000 BTU input or buildings with uses involving the preparation or serving of food or drink; and
(F) Buildings which, because of the special nature of their plumbing installation, as determined by the Building Official, are beyond the expertise of the codes staff.
