§ 116.02 LICENSE INFORMATION.
   (A)   Lawful gambling is permitted within the city provided it is conducted in accordance with M.S. §§ 609.75 through 609.763, inclusive, as they may be amended from time to time; M.S. §§ 349.11 through 349.23, inclusive, as they may be amended from time to time; and this chapter.
   (B)   Lawful gambling authorized by M.S. §§ 349.11 through 349.23, inclusive, as they may be amended from time to time, shall not be conducted unless approved by the Council, subject to the provisions of this chapter and state law.
   (C)   No license for operation of a gambling device shall be issued to any organization other than a fraternal, religious, veteran or other non-profit organization covered by M.S. § 290.05, subd. 1, clause (i) or (k), as it may be amended from time to time. Any such organization must have been in existence for at least three years prior to filing of the application for gambling license and must have at least 15 active members at the time of issuance of the license, and thereafter the organization must have at least 13 members eligible to vote on gambling matters.
   (D)   Any organization seeking to obtain a permit from the Board shall file with the City Clerk at least 60 days prior to an event an executed or complete duplicate of the following:
      (1)   City of Dilworth Gambling Permit;
      (2)   State gambling application for each event held; and
      (3)   Proof of organization’s current non-profit status.
