§ 8-1-7 CARELESS OPERATION OF A VEHICLE PROHIBITED; PENALTIES ESTABLISHED.
   (A)   It shall be unlawful for any person to operate any vehicle without care and caution and full regard for safety of persons or property. Any person failing to do so shall be guilty of careless driving or riding. The operation of any vehicle when the same or any of its appliances is not in proper or safe condition shall be prima facie evidence of careless driving or riding; careless operation is unlawful and may be a lesser included offense of reckless driving.
   (B)   It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this section.
   (C)   The fines for this offense are hereby established as follows:

Such charges may be adjusted from time to time in line with other code violations and as is permitted by law.
 
   (D)   It is the expressed and stated intent of Council that in plea bargaining situations when this offense is employed, no part of the fine will be suspended and no partial pay arrangements extended.
