§ 8-1-6 CRUISING PROHIBITED IN RESIDENTIAL AREAS; PENALTIES.
   (A)   Cruising as defined herein is hereby prohibited.
   (B)   For the purposes of this section, the following definitions apply:
      (1)   RESIDENTIAL DISTRICT.    A territory contiguous to and including a street or highway within the city and which has been designated as R-12, R-7, R-5, or MH Districts under the zoning laws of the city.
      (2)   POLICE CHECK POINT. Any place designated by a city police officer for the purpose of regulating and controlling traffic, when a city police officer is present at said place.
      (3)   STREET; HIGHWAY. The entire width between boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular traffic.
      (4)   CRUISING. Passing a police check point which has been established on a street or highway located in a residential area in a motor vehicle more than three (3) times within a two (2) hour period, after having been given written notice after the third passing in the same direction, that passing the police check point a fourth time in the same direction shall constitute a violation of this section.
   (C)   The penalty for a first conviction of this section shall be a fine not exceeding twenty-five dollars ($25). The penalty for a second or subsequent conviction within a one (1) year period shall be a fine not exceeding fifty dollars ($50).
   (D)   This section shall not apply to the following vehicles: emergency vehicles on patrol, taxicabs for hire, and other business vehicles being driven for business purposes.
