(A) All small businesses, businesses in residentially zoned areas and all churches, shall purchase, at their own expense, and use a mobile garbage toter if their garbage and trash needs are not more than one (1) mobile garbage toter full for weekly pick-up. Cardboard boxes shall be broken down and placed in the mobile toter and not on top of it or not beside it. Such establishments shall be subject to the basic garbage charges as contained herein.
(B) Any small businesses, business in a residentially zoned area or church, wanting garbage service, and which would use more garbage than could be handled by weekly servicing of a ninety (90) gallon mobile garbage toter, must obtain a metal bulk front loading garbage dumpster. All cardboard boxes must be placed within the container and not on top of it or beside it. The Service Director shall determine whether a church, small business, or business in a residentially zoned area needs a metal front loading dumpster or a mobile toter, based on his knowledge and information obtained from the sanitation route workers of previous garbage and trash use. If the city services a metal dumpster container to such business the charges will be based on the rates contained herein.
(C) The city will not pick up any irregular garbage cans at the places listed within this section.
(D) The owner, operator or legal owner of any property referred to in this section which at any given time has visible garbage or trash stored outside of an enclosed structure which is emitting a detectable odor or which is causing or having a common fly health related problem, shall be deemed guilty of a misdemeanor and subject to a fine not to exceed one hundred dollars ($100) or imprisonment not to exceed thirty (30) days, or both.
