For the purpose of this title, certain terms and words are defined as follows:
ALLEY: A public right-of-way designed to serve as a secondary access to the side or rear of those properties whose principal frontage is on a street.
AREA:
Area, Gross: The entire area within the boundary lines of the property proposed for subdivision/development, including any areas to be dedicated/reserved for street and alley rights-of-way and for public uses.
Area, Net: The entire area within the boundary lines of the tract proposed for subdivision, less the area to be dedicated for street and alley rights-of-way and/or other public purposes.
BLOCK: A tract of land bounded by streets or by a combination of streets, public parks, cemeteries, railroad rights-of-way, waterways or boundary lines of the corporate limits of the Village.
BOARD: Village Board of the Village of Dieterich.
COMPREHENSIVE PLAN: The plan or any portion thereof adopted by the Village of Dieterich for the coordinate physical development of Dieterich and environs.
DRIVEWAY: Private accessway leading from a street or alley to a dwelling unit or building.
EASEMENT: A strip of land upon which the owner grants a right of use to another for one (1) or more designated purposes.
FLAG LOT: A lot fronting on or abutting a public road and where access to the public road is by narrow, private right- of-way.
FRONTAGE: The dimensions of a lot measured at the street right-of-way.
IMPROVEMENT: Street work and utilities including, but not limited to, water, sewer, electric, gas and storm drainage, to be installed or agreed to be installed by the subdivider on land to be used for streets and/or easements, as are necessary for the general use of lot owners in the subdivision, local neighborhood traffic and drainage needs as a condition precedent to the approval and acceptance of the final plat thereof.
LOT: A portion of a subdivision or other parcel of land established for transfer of ownership or for building development, whether immediate or future.
LOT WIDTH: The lesser of the width of a lot at the front building line or back building line.
OWNER: Any person, firm, association, syndicate, partnership, corporation, trust, or any other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under this title.
PARCEL: Any existing area of land under single ownership which may be transferred according to applicable laws and ordinances without further surveying or platting being required.
PLANS: All drawings, including general plans, cross sections, profiles, working details and specifications, which the subdivider prepares or has prepared to show the character, extent and details of the improvements required in chapter 5 of this title.
PLAT: A map or drawing showing the lot and street arrangement or other features or details of the area being subdivided as required in this title for preliminary and final approval and recording.
SETBACK LINE: A line that is roughly parallel to the front, side or rear lot line establishing the minimum space to be provided as the front, side or rear yard.
STREET: A public or private thoroughfare which affords the principal means of access to abutting properties and whether designated as a freeway, expressway, thoroughfare, highway, road, parkway, avenue, boulevard, lane, place, circle, or however otherwise designated.
STREET, COLLECTOR: A street designated as a collector on the adopted Major Streets Plan of the Village or a street in a proposed subdivision which is intended to collect traffic from the minor streets within a neighborhood or a portion thereof and to distribute such traffic to arterial thoroughfares, in addition to providing access to properties abutting thereon.
STREET, CUL-DE-SAC: A minor street having but one (1) end open for vehicular traffic and with the other end permanently terminated by a circular turnaround.
STREET, DEAD END: A street having only one (1) end open to vehicular traffic; also referred to as a court.
STREET, LOCAL OR MINOR: A street other than an arterial thoroughfare or collector street and intended primarily for providing low volume traffic access to abutting properties of limited number.
STREET, MAJOR: A collector street or State or Federal highway.
STREET, STUB: A street that is temporarily terminated with a T-turnaround but is planned for future continuation.
STREET, TURNAROUND: A temporary arrangement as shown in the Subdivision Standards to provide a means for vehicles to turn around at the end of a stub street.
STREET, URBAN RESIDENTIAL NONCOLLECTOR: A local street in an area zoned single-family residential.
SUBDIVIDE: The process of dealing with land so as to establish a subdivision as defined in this section.
SUBDIVIDER: Any person, firm, association, syndicate, partnership, corporation, trust, or any other legal entity, dividing or proposing to divide land so as to constitute a subdivision as defined in this section and including any agent of the subdivider.
SUBDIVISION:
A. Either: 1) the division of land into two (2) or more parcels, any of which is less than five (5) acres, except for a subdivision defined herein as a minor subdivision; or 2) the establishment or dedication of land for all or a portion of a road, highway, street, or alley upon a tract of land regardless of size.
B. For purposes of this title, the following shall be considered a minor subdivision; provided, that, such minor subdivision does not create lots or parcels which conflict with the zoning regulations, as contained in title 10 of this Code, the land subdivision regulations, as contained in this title, the Village of Dieterich Comprehensive Plan, or the Official Map of the Village of Dieterich:
1. The revision of lot width or lot depth in an approved subdivision where all affected lots are under single ownership and which will not involve any streets or easements of access or drainage and utility easements; or
2. The sale or exchange of a parcel of land, or any portion thereof, between owners of adjoining and contiguous land, except where the transfer results in the creation of another buildable lot.
C. For purposes of this title, the following shall not be considered a subdivision:
1. The conveyance of parcels of land or interest therein for use as right-of-way for railroads or other public utility facilities and other pipelines which does not involve any new streets or easements of access;
2. Conveyances relating to the dedication of land for public use or instruments relating to the vacation of land impressed with a public use; or
3. A conveyance made to correct a description in a prior conveyance.
VILLAGE BOARD OF ZONING APPEALS AND PLANNING: Village of Dieterich Board of Zoning Appeals and Planning.
ZERO SIDE YARD LOT: A lot located in an R-3 or R-4 District of the Village zoned for attached single-family housing (duplex). (Ord. 488, 1-7-2002, eff. 2-6-2002; amd. Ord. 683-12, 1-3-2012; 2017 Code)
