9-4-4: DEVELOPMENT PERMIT:
A.   Permit Required: No person not exempted by State law shall commence any development activity in an area known to flood without first obtaining a development permit from the Village. The Village shall not issue a development permit if the proposed development does not meet the requirements of this chapter.
B.   Application For Permit: To obtain a permit, the applicant must first file a permit application on a form furnished for that purpose. The form must be completed and submitted to the Village Zoning Board Inspector. The application shall include the following information and/or documentation:
   1.   Name and address of applicant;
   2.   Site location of the property;
   3.   Drawings of the site, which are drawn to scale showing property line dimensions;
   4.   Existing grade elevations and all changes in grade resulting from excavation or filling sealed by a licensed engineer;
   5.   Elevation certificate executed by a surveyor, engineer, or architect or floodproofing certificate, as appropriate;
   6.   The location and dimensions of all buildings and/or additions to buildings;
   7.   Anticipated dates of initiation and completion of activity or the proposed development;
   8.   Copies of all other Federal, State, and local permits, approvals or permit-not-required letters that may be required for the type of activity proposed by the applicant;
   9.   Cost of the project or improvements as estimated by a licensed engineer or architect. A signed estimate by a contractor may also meet this requirement; and
   10.   Any other information or documentation as reasonably may be required by the Village Zoning Board Inspector in order to determine eligibility for a development permit or to enforce the terms of this chapter.
C.   Review Of Application: The Zoning Board Inspector shall review all permit applications to determine whether proposed building sites will be reasonably safe from flooding. If a proposed building site is in a flood prone area, all new construction and substantial improvements (including the placement of prefabricated buildings and manufactured homes) shall:
   1.   Be designed (or modified) and adequately anchored to prevent flotation, collapse, or lateral movement of the structure.
   2.   Be constructed with materials resistant to flood damage.
   3.   Be constructed by methods and practices that minimize flood damage.
   4.   Be constructed with electrical, heating, ventilation, plumbing and air conditioning equipment and other service facilities that are designed and/or located so as to prevent water from entering or accumulating within the components during flooding. (Ord. 746-13, 10-7-2013)
