7-5-3: CONSTRUCTION REQUIREMENTS:
A.   Driveway Culvert Access: Unless otherwise determined by the Village Board of Trustees, there shall only be one driveway culvert per parcel of record.
B.   New Culverts:
   1.   Payment For Installation: The cost of purchasing and installing the initial driveway culvert will be the responsibility of the permittee. The Village will estimate the material and installation costs and invoice the permittee. Once payment in full has been received, for the estimated cost of the material and installation, the Village will schedule a time to install the driveway culvert. If during the installation process, any additional costs are incurred by the Village, which are in excess of the original estimated amount, the Village will invoice the permittee for the additional costs, and permittee must pay the additional costs within fifteen (15) calendar days after the mailing of the invoice. If the original invoiced amount is less than the actual costs to install, the Village will reimburse the permittee for the overpayment.
   2.   Construction Standards: The location of the driveway culvert shall be as approved by the foreman, in his/her sole discretion. Once location of the driveway culvert is approved, the foreman will determine what size and length of culvert needs to be installed. All culverts shall be a minimum of twenty four feet (24') and a maximum of thirty six feet (36'), unless specific written approval to do otherwise is obtained from the foreman. All culverts shall also be a minimum of eight inches (8") in diameter, provided, however, that the foreman may require a larger diameter culvert to be installed if the foreman, in his or her sole discretion, deems a larger diameter culvert necessary. All culverts need to be set in gravel of good quality, and designed so as to allow the free flow of water through them. The area around the mouths of the culvert should be rocked-up or graded such as to prevent soil erosion. The culvert shall be an aluminized corrugated metal pipe. Either Village personnel, or a private contractor that has been approved by the foreman shall install the driveway culvert. After installation, the permittee shall convey the culvert to the Village, by appropriate bill of sale, dedication or other conveyance acceptable by the Village.
C.   Extending Existing Culverts:
   1.   Payment For Installation Of Extension: If a permittee desires to lengthen an existing culvert (to a maximum of 36 feet, unless specific written approval to do otherwise is obtained from the Street Department Foreman), the cost of the material and installation of the extension to the driveway culvert will be the responsibility of the permittee. The Village will estimate the material and installation costs and invoice the permittee. Once payment in full has been received, for the estimated cost of the material and installation, the Village will schedule a time to install the driveway culvert. If during the installation process, any additional costs are incurred by the Village, which are in excess of the original estimated amount, the Village will invoice the permittee for the additional costs, and permittee must pay the additional costs within fifteen (15) calendar days after the mailing of the invoice. D.   Replacing/Resetting Existing Culverts:
   1.   Payment For Installation Of Extension: The cost of replacing or resetting an existing driveway culvert will be the responsibility of the Village, only to the extent provided in this paragraph. The foreman shall determine the necessity of installing, replacing, or resetting a culvert. If the foreman determines, in his or her sole discretion, that a culvert does not need to be installed, replaced, or reset, the Village will not be responsible for performing the work. Furthermore, the Village will not be responsible for installing, replacing or resetting a culvert if the property owner causes the condition or damage which necessitates that a culvert be replaced or reset. The intent of this paragraph is to place responsibility on the homeowner if they cause the need for work to be performed, and to place responsibility on the Village, only when environmental or other uncontrollable factors cause the need for work to be performed. By way of example, and not limitation, a homeowner would be responsible for repairing or replacing a culvert if they ran over the end of it with a vehicle and closed off the end, or if they paved a large area and directed the run-off toward a culvert that was too small. The Village would be only responsible in such cases as rusted out culverts, or culverts that had risen due to frost action. The Village will replace existing culverts, up to the maximum of thirty six feet (36') and the property owner, at existing market rates for such culvert and materials, shall pay for any footage beyond the length or size of the existing culvert, up to a maximum of thirty six feet (36'). The Village will estimate the material and installation costs and invoice the landowner for the footage over the length or size of the existing culvert. Once payment in full has been received, for the estimated cost of the material and installation, the Village will schedule a time to replace and/or reset the driveway culvert. If during the installation process, any additional costs are incurred by the Village, which are in excess of the original estimated amount, the Village will invoice the permittee for the additional costs, and permittee must pay the additional costs within fifteen (15) calendar days after the mailing of the invoice. If the original invoiced amount is less than the actual costs to replace and/or reset the culvert, the Village will reimburse the permittee for the overpayment.
   2.   Construction Standards: The size and length of any replacement or reset culvert shall be approved by the foreman, in his or her sole discretion. Either Village personnel, or a private contractor that has been approved by the foreman, shall do all culvert replacements and/or resetting. After installation, the permittee shall convey the replacement or reset driveway culvert, as well as any existing driveway culvert to the Village, by appropriate bill of sale, dedication or other conveyance acceptable by the Village.
E.   Driveway Surface: A permittee, at the permittee's sole expense, may use concrete or hot mix on the surface of the driveway over the culvert so long as such concrete or hot mix does not damage or interfere with the Village's use or maintenance of the public way. Should the Village need to thereafter replace that culvert after it has been covered over by concrete or hot mix, it shall be the property owner's responsibility, at the property owner's expense, to repair and/or replace the concrete or hot mix.
