ORDINANCE NO. 1155-24
 
AN ORDINANCE AMENDING ORDINANCE NO. 742-13, AS AMENDED,
AND AMENDING CERTAIN SEWER RATES
WHEREAS, on the 5th day of August, 2013, the Village of Dieterich, Illinois, adopted Ordinance No. 742-13, An Ordinance Establishing a Policy for the Provision of Water, Sewer, and Garbage Services for the Village of Dieterich, County of Effingham, State of Illinois, as amended from time to time; and,
   
   WHEREAS, the Board of Trustees of the Village of Dieterich, Illinois, after careful consideration and investigation, has determined that it is reasonable and necessary to increase certain sewer service rates.
 
   NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF DIETERICH, ILLINOIS, THAT:
 
   Section 1:   The findings made in the prefatory portion of this Ordinance are hereby adopted.
 
   Section 2:   Retroactive to and effective January 01, 2024, Section 3 of Division II of Ordinance No. 742-13, as previously amended, is hereby deleted and replaced with the following:
 
Section 3.   Sewer Rates: The following rates are hereby imposed for sewer services:
 
   A.   Minimum Monthly Sewer Service Fee Per Customer:      $11.70
      (Includes first 1,500 gallons)
 
   B.   Rate Per 1,000 Gallons Used Per Month After First 1,500 Gallons:   $ 2.79
 
C.   Automatic Rate Increase: Beginning the 1st day of January, 2025, on the first billing period of each calendar year for the next three (3) calendar years after the adoption of this Ordinance, both the Minimum Monthly rate and the rate established for each 1,000 Gallons used per month after the First 1,500 Gallons shall be increased on an annual basis in accordance with the Consumer Price Index for Urban Wage Earners and Clerical Workers (1967 = 100) for All Items of All Cities, issued by the United States Department of Labor (hereinafter referred to as the “CPI”) for that year. If the adjusted rates for any calendar year, as calculated by the CPI, are lower than the rates for the prior year, then the rates shall not be adjusted for that calendar year. Notwithstanding the foregoing, before any automatic rate increase is imposed, the Village Board can vote to not adjust the rate to the full calculated CPI for any calendar year.
 
Section 3:    Except as herein expressly modified by Section 2 above, the provisions of Ordinance No. 742-13, as amended, shall remain in full force and effect.    
 
Section 4:    This Ordinance shall become effective upon approval and passage as required by law.
 
Section 5:    In the event that a court of competent jurisdiction finds that any provision of this Ordinance is invalid, then the remaining provisions of this Ordinance shall remain in full force and effect.
