17-307: SETBACK REQUIREMENTS FOR CERTAIN SANITARY SEWER DISPOSAL SYSTEMS:
   A.   Certain types of sanitary sewer systems, commonly referred to as "wetlands" or lateral bed disposal type systems, may be installed at home and/or residence sites in the corporate limits of Dickson, Oklahoma, on certain minimum sized (5 acres or more) tracts.
   B.   Any "wetlands" or lateral bed disposal type sewer system, described as a system designed to dispose of sanitary and/or human waste which utilizes a dug pit or "wet box", with vegetation and layers of gravel, sand, dirt, and/or rock therein, shall not be placed, installed or dug any closer than two hundred feet (200') from any adjoining property line.
   C.   Any lateral bed disposal sanitary sewer and/or disposal system which is commonly referred to as a "wetlands" type system, consisting of a pit or "wet box" and consisting of layers of gravel, sand, dirt, and/or planted "wetlands" type vegetation, may be installed and/or developed at any residential or home site within the corporate limits of Dickson, Oklahoma, provided the following minimum requirements are met:
      1.   The real property where the "wetlands" or lateral bed disposal type sanitary sewer system is to be installed or dug shall consist of one tract of land consisting of not less than five (5) acres of realty, said tract being titled in the name of one owner or resident as reflected in the official records of the county clerk of Carter County, Oklahoma, which shall include by definition husband and wife; and
      2.   The actual lateral system, "wet box", "bed" or "pit" of any "wetlands" type sanitary sewer system shall not be installed or placed in any location closer than two hundred feet (200') from the actual property line of any adjoining property owner.
   D.   In event any lateral bed disposal, "wetlands" or "wet box" type sanitary sewer system as described herein is installed or developed on any residential site or on any real property within the corporate limits of Dickson, Oklahoma, without strict compliance with this section, then and in said event, any citizen affected by the installation or development shall have the right to private injunctive relief, and in addition, the board of trustees may authorize, by resolution, the installation of civil injunctive relief by the town attorney of Dickson if the violation is such that the public interests are adversely affected.
   E.   Any person, firm, entity, corporation, partnership, or association, which installs any type of lateral bed disposal system, sometimes referred to as a "wetlands" or "wet box" type sanitary sewer disposal system, as described herein on real property within the corporate limits of Dickson, Oklahoma, in violation of this section, shall be deemed guilty of an offense, and upon conviction thereof in the municipal court of Dickson, Oklahoma, shall be liable for a fine of not more than twenty dollars ($20.00) plus court costs and service fees. Each day of violation shall be deemed a separate offense and/or violation.
   F.   The department of environmental quality, state of Oklahoma, formerly known as the Oklahoma state department of health, is hereby prohibited and enjoined from granting approval or consent to any person, firm, corporation, partnership, group, or association for any type of lateral bed disposal system as described herein, if the planned disposal system does not comport with the minimum requirements of this section.
