10-413: CURFEW FOR JUVENILES:
   A.   Definitions:
   CUSTODIAN: Any person over the age of twenty one (21) years who is in loco parentis to a school age child.
   GUARDIAN: Any person other than the parent who has legal guardianship of a school age child or minor.
   PARENT: The natural or adoptive parent of a school age child.
   PUBLIC PLACE: Any street, alley, parking lot, highway, sidewalk, park, playground or place to which the general public has access and a right to resort for business, entertainment or other lawful purpose. A public place shall include, but not be limited to, any store, shop, restaurant, tavern, bowling alley, cafe, drugstore, parking lot, poolroom, pizza parlor, shopping center, and any other place devoted to amusement or entertainment of the general public. It shall also include the front or immediate area of the above.
   SCHOOL AGE CHILD OR MINOR: Any child over the age of five (5) years and under the age of eighteen (18) years and who has not finished four (4) years of high school. (Ord. 53, 8-18-2000, eff. 8-18-2000) !DEFEND!
   B.   Unlawful Activity:
      1.   It shall be unlawful for any minor or child of school age to remain, wander, stroll or play in any public place on foot or to cruise about without a set destination in any motor vehicle in, about or upon any place in Dickson, Oklahoma, during the hours of one minute after twelve o'clock (12:01) A.M. and six o'clock (6:00) A.M. Saturday; between one minute after twelve o'clock (12:01) A.M. and six o'clock (6:00) A.M. Sunday and between eleven o'clock (11:00) P.M. and six o'clock (6:00) A.M. Sunday through Thursday, unless: (Ord. 67, 12-17-2007)
         a.   The school age child is accompanied by a parent, guardian, custodian or other adult person having custody or control of such school age child;
         b.   The school age child is on an emergency errand or specific business or activity directed or permitted by his parent, guardian or other adult person having the care and custody of the school age child;
         c.   Where the presence of the school age child is connected with or required by some legitimate employment, trade, profession or occupation; or
         d.   The school in which the school age child is enrolled is not in session for that particular day. (Ord. 53, 8-18-2000, eff. 8-18-2000)
   C.   Knowingly Permit: (Rep. by Ord. 67, 12-17-2007)
   D.   Exceptions: It shall be unlawful for any parent, guardian, custodian or other adult person having custody or control of any minor child to suffer or permit or by inefficient control to allow a minor or school age child to be on any public place within Dickson, Oklahoma, during the hours that school is in session. The provisions of this section shall not apply if:
      1.   The school age child is accompanied by a parent, guardian, custodian or other adult person having custody or control of such school age child;
      2.   The school age child is on an emergency errand or specific business or activity directed or permitted by his or her parent, guardian or other adult person having the care and custody of the school age child;
      3.   Where the presence of the school age child is connected with or required by some legitimate employment, trade, profession or occupation; or
      4.   The school in which the school age child is enrolled is not in session for that day. (Ord. 53, 8-18-2000, eff. 8-18-2000)
   E.   Violation; Parent Or Guardian: Any parent, guardian, or custodian of a school age child who violates any provision of this section shall be deemed guilty of offenses, and upon conviction thereof, shall be subject to a fine of one hundred dollars ($100.00). Each day of violation shall be deemed a separate offense.
   F.   Violation; School Age Child: Any school age child who violates any provision of this section shall be deemed guilty of an offense and upon conviction thereof, shall be subject to a fine of one hundred dollars ($100.00). Each day of violation shall be deemed a separate offense.
