(A) The Model Stream and Wetland Protection Ordinance as published by the Northeastern Illinois Planning Commission is hereby enacted by the Village of Diamond, Illinois, with modifications as stated herein. These provisions are hereby adopted by reference and made a part hereof as though the same were fully set forth herein verbatim. The ordinance shall be interpreted in accordance with those portions of the ordinance marked as “Commentary.”
(B) The Model Stream and Wetland Protection shall be modified as follows.
(1) Section 1.00 shall be deleted and replaced with the following text: “The Lowland Conservancy Overlay District is adopted by the Village of Diamond, IL under the authority of the Illinois Revised Statutes, Chapter 24, Paragraphs 11-13-1 et. seq.”
(2) Wherever the term “local government name” shall appear in the text of the model ordinance, the same shall be replace with “the Village of Diamond, IL.”
(3) Wherever the term “permit issuing agency” shall appear in the text of the model ordinance, the same shall be replace with “the Village of Diamond, IL.”
(4) The permit application fee prescribed by section 5.01 shall be $200, and shall be in addition to any other fee prescribed by other ordinances of the Village of Diamond, Illinois.
(5) The fine prescribed by Section 16.02 shall be not more than $500 for each offense.
(6) The effective date prescribed by Section 17.00 shall be the effective date stated herein.
(C) This section shall be in full force and effect from and after its passage and approval as provided by law and shall be published in pamphlet form.
