§ 130.99 PENALTY.
   (A)   Any person violating any provision of this title for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   (1)   (a)   The penalty for violation of § 131.01(C) shall be a fine of not less than $50 nor more than $750. In addition to the fine, the offender may be ordered by the court to pay restitution to the property owner for the costs of restoring the property to its state prior to the application of graffiti.
         (b)   The penalty for violation of § 131.01(D) shall be a fine of not less than $50 nor more than $750 and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
         (c)   The penalty for violation of § 131.01(E) or (F) shall be a fine of not less than $50 nor more than $750.
      (2)   Any person convicted of violating any provision of § 131.02 shall be guilty of a petty offense and shall be fined not less than $10 nor more than $750.
      (3)   Any person violating § 131.04 shall be fined not less than $50 nor more than $750. Furthermore, if the person is not the owner of the building being used for gang-related activity, the court may order the offender to pay restitution to the owner for the costs of any damage caused by the gang-related activity, unless the owner knew or should have known that the activity was taking place and negligently or willfully failed to notify the village of the occurrence of the activities.
      (4)   Any person convicted of violating § 131.06 shall be guilty of a petty offense and shall be fined not less than $50 nor more than $750.

   (C)   Any person violating any of the provisions of § 136.01 shall, on conviction thereof, be fined not less than $5, nor more than $750, and each day or part of the day that any provisions of any of § 132.01 shall be violated shall be considered a separate offense.

   (D)   Any person, firm, or corporation violating any of the provisions of § 137.05 shall, upon conviction thereof, be fined in an amount not exceeding $750.
