§ 154.41 INTERNATIONAL EXISTING BUILDING CODE - 2015
   (A)   Code adopted. There is hereby adopted by reference as if fully set forth herein, that certain Building Code known as the International Existing Building Code - 2015 edition, including Appendix B, supplementary Accessibility Requirements for Existing Buildings and Facilities; and as thereafter amended and on file with the Village Clerk, as the Existing Building Code for the Village.
   (B)   Copies on file. At least one copy of the International Existing Building Code - 2015 has been on file in the Village Hall for more than 30 days prior to the adoption hereof and is now on file. The Building Officer shall keep on file in his or her office at least one copy of the International Existing Building Code - 2015, which shall be available for inspection.
   (C)   Special provisions. The following words, provisions, and paragraphs are to be added to the following designated sections of the International Existing Building Code - 2015. These provisions supersede the requirements of the indicated provisions of such code.
      101.1 Title: Insert Village of Diamond.
      103 Department of Building Safety: Shall be deleted in its entirety and replace as follows:
         The Building Official shall be charged with the enforcement of the Existing Building Code and shall be known as the code official,
      105.3 Application For Permit: Add the following:
         8.   Where applicable, describe the land in which the proposed work is to be done by legal description, street address, and signed sealed copy of plat of survey prepared by an Illinois Licensed Professional Land Surveyor.
      106.2.2 Information On Construction Documents: Shall be added as follows:
         Construction documents shall be dimensioned and drawn on 36" x 24" or larger paper and have an Illinois Licensed Professional Architect stamp on all pages. Deviations from the size requirements may be approved by the Building Official.
      106.3.3 Phased Approval: Shall be deleted in its entirety.
      108.6 Refunds: Shall be deleted in its entirety.
      Section 112 Board of Appeals: Shall be deleted in its entirety and replace as follows:
         That any person, firm or corporation shall have the right to appeal a decision of the Building Official to the Village Planning and Zoning Commission. Means of appeal shall follow requirements set forth in Section 14.06, Appeals of Administration Decisions, of the Village Zoning Code.
      113.1 Unlawful Acts: Shall read as follows:
         It shall be unlawful for any person, firm or corporation to alter, extend, add, repair, move, remove, demolish or change the occupancy of any building or equipment regulated by the International Existing Building Code or amendments to the International Existing Building Code as herein provided, or cause same to be done, in conflict with or in violation of any of the provisions of the International Existing Building Code or amendments to the International Existing Building Code as herein provided.
      113.2 Notice Of Violation: Shall read as follows:
         The Building Official is authorized to serve a notice of violation or order on the person responsible for the alteration, extension, repair, addition, moving, removal, demolition or change in the occupancy of a building in violation of the provisions of the International Existing Building Code or amendments to the International Existing Building Code as herein provided, or In violation of a permit or certificate issued under the provisions of the International Existing Building Code. Such order shall direct the discontinuance of the illegal action or condition and the abatement of the violation. Administrative notices are attempts to secure voluntary compliance and are not the start of prosecution for jurisdictional purposes.
      113.3 Prosecution of Violation: Shall read as follows:
         If the notice of violation is not complied with promptly, the Building Official is authorized to request the legal counsel of the Village to institute the appropriate proceeding at law or in equity to restrain, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the building or structure in violation of the provisions of the International Existing Building Code or amendments to the International Existing Building Code as herein provided or of the order or direction made pursuant thereto.
      113.4 Violation Penalties: Shall read as follows:
         Any person who violates a provision of the International Existing Building Code or amendments to the International Existing Building Code as herein provided or fails to comply with any of the requirements thereof or who alters or repairs a building or structure In violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provision of the International Existing Building Code, or amendments to the International Existing Building Code as herein provided shall be subject to penalties as prescribed by law and as provided in Section 10.99 of the Village Code. Each day that a violation continues shall be deemed a separate offense.
      114.3 Unlawful Continuance: Shall read as follows:
         Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties as prescribed by law and as provided in Section 10.99 of the Village Code.
      116.6 Hearing: Shall read as follows:
         Any person ordered to take emergency measures shall comply with such order forthwith. Any affected person shall thereafter, upon petition directed to the Village Planning and Zoning Commission as set forth in Section 112 of the International Existing Building Code be afforded a hearing as described in Section 112 of the International Existing Building Code.
