§ 154.36 INTERNATIONAL RESIDENTIAL CODE - 2015.
   (A)   Code adopted. There is hereby adopted by reference as if fully set forth herein, that certain Building Code known as the International Residential Code - 2015 edition, including Appendix F, Radon Control Methods, Appendix H, Patio Covers, Appendix J, Existing Buildings and Structures, Appendix K, Sound Transmission; Appendix O, Automatic Vehicular Gates; and as thereafter amended and on file with the Village Clerk, as the Residential Code for the Village.
   (B)   Copies on file. At least one copy of the International Residential Code - 2015 has been on file in the Village Hall for more than 30 days prior to the adoption hereof and is now on file. The Building Official shall keep on file in his or her office at least one copy of the International Residential Code - 2015, which shall be available for inspection.
   (C)   Special provisions. The following words, provisions, and paragraphs are to be added to the following designated sections of the International Residential Code - 2015. These provisions supersede the requirements of the indicated provisions of such code.
      R101.1 Title: Insert Village of Diamond.
      R103 Department of Building Safety: Delete in its entirety and insert as follows:
         The Building Official shall be charged with the enforcement of the Residential Code as amended herein.
      R105.2 Work Exempt From Permit: Delete the following:
         Building: Numbers 10
      Add the following:
         Retaining walls with an unbalanced soil load of 30 inches or less in height;
         Decks less than 200 square feet with an elevation less than 30 inches above grade at any point.
      R105.3 Application For Permit: Add the following:
         8.   Where applicable, describe the land in which the proposed work is to be done by legal description, street address, and signed sealed copy of plat of survey prepared by an Illinois Licensed Professional Land Surveyor.
      R106.1.1 Information On Construction Documents: Shall be added as follows:
         Construction documents shall be dimensioned and drawn on 36" x 24" paper and have an Illinois Licensed Professional Architect stamp on all pages. Deviations from the size requirements may be approved by the Building Official.
      R106.3.3 Phased Approval: Shall be deleted in its entirety.
      R108.5 Refunds: Shall be deleted in its entirety.
      R108.6 Work Commencing Before Permit Issuance: Shall be added as follows:
         Persons who commence or complete work without obtaining the required building permit, in addition to any other fines or penalties, shall be required to pay a penalty prior to issuance of the building permit. The penalty for commencing or completing work without obtaining the required building permit shall be the cost of the standard building permit fee, with a maximum penalty as set forth in Section 10.99 of the Village Code.
      R112 Board Of Appeals (Board of Appeals, delete section and insert):
         That any person, firm or corporation shall have the right to appeal a decision of the Building Official to the Village Planning and Zoning Commission. Means of appeal shall follow requirements set forth in Section 14.06, Appeals of Administrative Decisions, of the Village Zoning Code.
      R113.1 Unlawful Acts: Shall read as follows:
         It shall be unlawful for any person, firm or corporation to erect, construct, alter, extend, repair, move, remove, demolish or occupy any building, structure or equipment regulated by the International Residential Code or amendments to the International Residential Code as herein provided, or cause same to be done, in conflict with or in violation of any of the provisions of the International Residential Code or amendments to the International Residential Code as herein provided.
      R113.2 Notice Of Violation: Shall read as follows:
         The Building Official is authorized to serve a notice of violation or order on the person responsible for the erection, construction, alteration, extension, repair, moving, removal, demolition or occupancy of a building or structure in violation of the provisions of the International Residential Code or amendments to the International Residential Code as herein provided, or in violation of a detail statement or a plan approved thereunder, or in violation of a permit or certificate issued under the provisions of the International Residential Code or amendments to the International Residential Code as herein provided. Such order shall direct the discontinuance of the illegal action or condition and the abatement of the violation. Administrative notices are attempts to secure voluntary compliance and are not the start of prosecution for jurisdictional purposes.
      R113.3 Prosecution Of Violation: Shall read as follows:
         If the notice of violation is not complied with promptly, the Building Official is authorized to request the legal counsel of the Village institute the appropriate proceedings at law or in equity to restrain, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the building or structure in violation of the provisions of the International Residential Code or amendments to the International Residential Code as herein provided or of the order or direction made pursuant thereto.
      R113.4 Violation Penalties: Shall read as follows:
         Any person who violates a provision of the International Residential Code or amendments to the International Residential Code as herein provided or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of the International Residential Code or amendments to the International Residential Code as herein provided, shall be subject to penalties as prescribed by law and as provided in Section 10.99 of the Village Code. Each day that a violation continues shall be deemed a separate offense.
      R114.1 Notice To Owner: Shall read as follows:
         Upon notice from the Building Official that work on any building or structure is being prosecuted contrary to the provisions of the International Residential Code or amendments to the International Residential Code as herein provided or in an unsafe and dangerous manner, such work shall be immediately stopped. The stop work order shall be in writing and shall be given to the owner of the property involved, or to the owner’s agent or to the person doing the work and shall state the conditions under which work will be permitted to resume.
      R114.2 Unlawful Continuance: Shall read as follows:
         Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties as prescribed by law and as provided in Section 10.99 of the Village Code.
      R114.3 Restoration (new subsection)
         R114.3 Restoration. A structure declared unsafe by the Building Code may be restored to safe condition as provided in Section R114.1 hereof; provided that if the damage or cost of reconstruction or restoration is fifty percent (50%) or more of its current replacement value, it shall be made to conform, with respect to materials and type of construction, to the requirements for new structures as provided for in the Residential Code. Replacement value is three times the assessed valuation of the improvement (based on information obtained from the Grundy or Will County Assessor). When assessed valuation data is not available, replacement value shall be determined by an insurance adjuster. If the property is not insured and assessed value information is not available, the average quotes from a minimum of two general contractors shall be used.

      R302.3 Two-Family Dwellings: Shall read as follows:
         Dwelling units in two-family dwellings shall be separated from each other by wall and floor assembled having not less than a 2-hour fire resistance rating where tested in accordance with ASTM E 119 or UL 263. Fire-resistance-rated floor/ceiling and wall assemblies shall extend to and be tight against the exterior wall, and wall assemblies shall extend from the foundation to the underside of the roof sheathing.
         Exceptions:
            1.   A fire-resistance rating of 1-hour shall be permitted in buildings equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13,13D, or 13R.
            2.   Wall assemblies need not extend through attic spaces where the ceiling is protected by not less than 5/8-inch (15.9 mm) Type X gypsum board, an attic draft stop constructed as specified in Section R302.12.1 is provided above and along the wall assembly separating the dwellings, and the structural framing supporting the ceiling is protected by not less than 1/2-inch (12.7 mm) gypsum board or equivalent.
      R309.1 Floor Surface: Add the following after the last sentence:
         If a door opening occurs between the garage and dwelling, provide a six inch (6") curb at the door, or construct garage floor six inches (6") lower than adjoining floor. If a stairwell occurs in garage, a six inch (6") gas curb in addition to a 36" minimum landing at the curb height shall be provided around the stairwell. The foundation wall can serve as the gas curb provided the highest elevation of the garage floor is six inches (6") below the top of foundation.
      R313 Automatic Fire Sprinkler Systems: Shall be deleted in its entirety.
      R315.3 Location:  Shall read as follows:
         Carbon monoxide alarms in dwelling units shall be installed outside of each separate sleeping area within fifteen (15) feet of each bedroom or sleeping area. Where a fuel-burning appliance is located within a bedroom or its attached bathroom, a carbon monoxide alarm shall be installed within the bedroom. Where a bedroom is located directly above a garage, or other motor vehicle storage space, a carbon monoxide shall be installed within the bedroom.
      R319.1 Address Identification: Add the following after the last sentence:
         All multi-tenant residential dwelling units shall have additional address numbering placed on the rear door, if appropriate, with the same requirements noted above.
      R402.1 Wood Foundations: Shall be deleted in its entirety. Also, delete all references to wood foundations.
      R903.6 Gutters And Downspouts: Add new section as follows:
         All structures shall be provided with gutters and downspouts unless omission is specifically permitted by the Building Official.
      P2501-P3301 Illinois State Plumbing Code: Shall be added as follows:
         All plumbing work shall conform to the Illinois State Plumbing Code, current edition, as amended by the Village of Diamond.
      P2603.5.1 Sewer Depth: Delete as follows:
         Building sewers that connect to private sewage disposal systems shall be a not less than [NUMBER] inched (mm) below finished grade at the point of septic tank connection.
      Insert as follows:
         Building sewers shall not be less than 42 inches below grade.
      E3401-4301 National Electric Code: Shall be added as follows:
         All electrical work shall conform to the National Electric Code-2014 edition.
