§ 150.69 REQUIREMENTS FOR REMOVAL OR REBUILDING.
   (A)   Any building or structure within the corporate limits of the village which has or may be damaged by fire, decay, flood, wind, earthquake, man or other cause to the extent of 50% of its pre-damaged market value, shall be torn down or removed.
   (B)   Upon written notice of such damaged building by the Building Inspector, Commissioner of Public Health, Safety and Parks, or the Fire Chief of the local Fire Protection District, filed with the Village Clerk, the Village Clerk shall notify the Village Mayor of the receipt of such notice. The Village Mayor may appoint a 3 person committee to determine whether or not such building or structure has been damaged to the extent of 50% of its pre-damaged market value. A copy of said notice, together with a notice of the appointment of the committee to determine the damage, shall be served upon the owner of the premises by personal service or by registered mail to his last known address.
   (C)   The notice may be in substantially the following form:
      "To                                                     (owner of the premises).
      You are hereby notified that                                         has determined that the building owned by you at                                                        located within the corporate limits of the Village of Diamond has been damaged by fire, decay, flood, wind, earthquake, man or other cause to the extent of fifty percent (50%) of its pre-damaged market value; and that a committee of three (3) members has been appointed to verify this finding, which committee will hold its first meeting in the Diamond Village Hall on the       day of                    , 20    at the hour of          o'clock, at which time it will determine whether this finding is correct. If this finding is verified by the committee, you must tear down and remove that said building."
   (D)   If the committee of 3 members determines that the building in question has been damaged to the extent of 50% of its pre-damaged market value, it shall be the duty of the owner to tear down or remove the said building within 20 days after the finding of the committee; and it shall be unlawful to occupy or permit such building to be occupied after such finding and such building shall be deemed a nuisance under this section. Additionally, until said building is torn down or removed, the village shall not issue a building permit to the owner or occupant of the premises.
