(A) Enforcement of this chapter shall be by any law enforcement officer acting in his or her official capacity, when a violation of the chapter is observed or reported in the village.
(B) The law enforcement officer shall issue a citation with a court date not less 21 days or more than 45 days from the date of the ordinance violation. The accused must appear on the court date before the presiding judge in the Grundy County Circuit Court or Will County Circuit Court, as may be the case. If a violator wishes a hearing to contest the violation, he or she must file a written request for a hearing within 21 days of the issuance of the citation with the Circuit Clerk of Grundy County or the Circuit Clerk of Will County, as the case may be, with a copy to the Grundy County State's Attorney or the Will County State's Attorney, as the case may be. At the trial on the merits of the citation, the Illinois Civil Rules of Procedure will apply, and the standard of proof would be by a preponderance of the evidence.
(C) If the violator wishes to admit the violation of the ordinance, he or she may avoid a court appearance by working out the appropriate fine with the State's Attorneys Office, who may agree that the fine be paid over the counter to the Grundy County Treasurer or the Will County Treasurer, as the case may be.
