§ 150.24 RESIDENTIAL CONSTRUCTION BUILDING PERMIT FEE DEFERRAL PROGRAM.
   (A)   Recitals.
      (1)   On March 23, 2010, the Board of Commissioners of the Village of Diamond adopted an ordinance providing for required inspection for residential construction and amending various ordinances relating to fees for building permits and related items (Ordinance Number 2010-04); and
      (2)   In an effort to stimulate new residential construction within the Village of Diamond, the Village of Diamond is willing to defer payment of 50% of the up-front cost for new residential construction building permit fees as herein provided; and
      (3)   It is in the best interest of the Village of Diamond to stimulate new residential construction in order to create and sustain jobs within the Village of Diamond and to create growth in the village's tax base.
   (B)   New residential construction building permit fee deferral program.
      (1)   The fees for new residential construction building permits shall be due and payable as follows:
         (a)   Fifty percent thereof prior to the issuance of a building permit; and
         (b)   Fifty percent thereof prior to issuance of a final or temporary certificate of occupancy for such residential unit, or after the passage of 12 months after issuance of the new residential construction building permit, whichever occurs first.
      (2)   As a condition of the deferment of time and payment of the building permit fees, the property owner shall be required to execute a letter agreement secured by a lien, acknowledging that all building permit fees will be paid prior to issuance of a final or temporary certificate of occupancy for such residential unit, or after the passage of 12 months after issuance of the building permit, whichever occurs first. The new residential construction building permit fee deferral program shall expire on December 31, 2013.
