(A) If the terrain or lot size does not allow for the installation of a curtain drain, the contractor may apply for a variance to be approved by a representative of the Health Department. A variance shall also be submitted by the contractor if one of the following conditions exist:
(1) Existing field tiles are located within proximity of the system and assist with lowering the seasonally high water table or limiting layer.
(2) Land formations such as elevation changes or bodies of water are located within the proximity of the system and assist in lowering the seasonally high water table or limiting layer.
(B) If a variance is denied, alternative technology may be required after approval is granted from the Illinois Department of Public Health.
