§ 31.04 BOARD OF HEALTH; HOME HEALTH SERVICES; FEES; GIFTS AND BEQUESTS.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      BOARD. The Board of Health of the county (or the Board of Health of DeWitt-Piatt County Health Unit).
      DEPARTMENT. The County (or multiple-County) Health Department of the County of DeWitt-Piatt.
      HOME HEALTH AGENCY or AGENCY. The Health Department of the County (or multiple-county) of De Witt-Piatt which is responsible for providing the home health service in accordance with the certification standards established by the State Department of Public Health.
      HOME HEALTH SERVICE. Those items and services furnished to individuals, under the care of a physician, on a visiting basis in a place of residence used as an individual’s home. These services are provided by the home health agency under a plan for furnishing the items and services to an individual, established and periodically reviewed by the patient’s physician, and includes part-time or intermittent nursing care provided by or under the supervision of a registered professional nurse, and the services of one or more of the following: physical, occupational or speech therapy, medical social work or part-time or intermittent services of a home health aide.
   (B)   Pursuant to ILCS Ch. 55, Act 5, §§ 5-25001 et seq., the Board of Health is authorized to collect fees for service rendered by the home health agency.
   (C)   The Board is authorized to:
      (1)   Accept gifts and bequests for the purpose of administering the home health service program and to expend the gifts and bequests, or invest the gifts and bequests and expend the income therefrom, for the maintenance of the home health service; and
      (2)   Deposit all gifts and bequests received which are not otherwise invested, the income from those gifts and bequests which are invested, and all fees collected, in the County Health Fund to the credit of the home health service.
