§ 90.035 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   DOMESTIC ANIMALS. Include dogs, cats, birds, reptiles, rodents and any other animal commonly sold for companionship at retail pet store establishments. If an animal not clearly being a domestic animal as defined in this section is encountered in the duties of the Animal Control Administrator, the Public Safety Committee Chairman’s determination as to whether an animal is domestic or not shall control.
   OWNER. A person having a right or property in a dog or cat or who keeps or harbors a dog or cat, or who has it in his or her care, or acts as its custodian, or who knowingly permits a dog or cat to remain on or about any premises occupied by him or her.
   RUNNING AT LARGE. A dog or cat, means a dog or cat off or outside the premises of its owner, unless it is controlled as follows:
      (1)   By a line or leash not more than eight feet in length; provided that, the line or leash is held by a competent person;
      (2)   At “heel” of a competent person;
      (3)   The dog or cat is confined within a vehicle being driven, parked or stopped; or
      (4)   The dog or cat is not more than 50 feet from a competent person; provided that, the dog is not annoying any person, trespassing on private property or in public area where dogs are forbidden.
   SUBDIVISION. Any parcel divided into two or more parts for the purpose of transfer of ownership for residential building development, including all public streets, alleys, ways of public service facilities, parks, playgrounds or other public grounds contained within the area of the entire parcel. A SUBDIVISION shall include parcels of over five acres subject to the Plat Act of the county subdivision regulations which are used principally for residential purposes.
