§ 93.99 PENALTY.
   (A)   Any person who violates any provision of this chapter for which no penalty is provided shall be subject to the terms of § 10.99.
   (B)   Any person found to be in violation of any section of §§ 93.01 through 93.04 shall be deemed guilty as follows:
      (1)   A first offense shall be deemed a civil infraction punishable by a fine of not more than $50, which may be suspended at the discretion of the Magistrate.
      (2)   A second offense, or first offense which is especially obnoxious, shall be deemed a civil infraction, punishable by a fine of not more than $350.
      (3)   A third offense committed within 12 months shall be deemed a Class 1 misdemeanor, punishable by a fine of not more than 2,500, imprisonment for up to 180 days or any combination of both.
