Matters subject to the administrative hearings system provided for by this code are charges of violation of any ordinance (alternatively, "city code", "code") of the city of Des Plaines so long as the charge is not a "moving traffic violation", the relief sought is not a penalty of incarceration or a fine in excess of fifty thousand dollars ($50,000.00), excluding allowable costs. The maximum monetary fine under section 1-16-5 of this chapter shall be exclusive of costs of enforcement or costs imposed to secure compliance with the municipality's ordinances and shall not be applicable to cases to enforce the collection of any tax imposed and collected by the municipality.
Whenever a provision of this code authorizes a city official or employee to institute a court proceeding or seek an order from a judge regarding the violation of a city ordinance, the official or employee is also authorized to institute an administrative hearing in the administrative hearings program in accordance with the rules herein set forth.
