10-1-2: AMENDMENTS TO THE INTERNATIONAL BUILDING CODE:
The 2015 international building code, adopted and incorporated by reference pursuant to this chapter, is hereby amended, in relevant part, to read as set forth in this section. Subsequent section numbers used in this section refer to the like numbered sections of, or new sections added to, the 2015 international building code. Whenever a conflict arises between the provisions of the 2015 international building code and the amendments set forth in this section, the following amendments will control: (Ord. [A] 101.1 Title.
These regulations shall be known as the building code of the city of Des Plaines, hereinafter referred to as "this code."
[A] 101.2.1 Appendices.
Provisions in the appendices shall not apply unless specifically adopted. Appendices F and K are hereby adopted.
[A] 101.4.3 Plumbing.
The provisions of the Illinois plumbing code, 68 Ill. admin. code 890.110 et seq., shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. The provisions of the Illinois plumbing code shall apply to private sewage disposal systems.
[A] 101.4.6 Energy.
The provisions of the Illinois energy conservation code, 71 Ill. admin. code 600.100 et seq., shall apply to all matters governing the design and construction of buildings for energy efficiency.
[A] 105.1 Required.
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, to alter any grading of a property, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit.
[A] 105.2 Work Exempt From Permit.
Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:
Building:
1.Vinyl storage cabinets not larger than 36 square feet.
2.Oil derricks.
3.Retaining walls that are not over 4 feet in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding class I, II or IIIA liquids.
4.Water tanks supported directly on grade if the capacity is not greater than 5,000 gallons and the ratio of height to diameter or width is not greater than 2:1.
5.Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.
6.Temporary motion picture, television and theater stage sets and scenery; provided, however, that the use of such sets and scenery may require a special event license and/or registration with the city of Des Plaines.
7.Prefabricated swimming pools accessory to a group R-3 occupancy that are less than 24 inches deep, are not greater than 5,000 gallons and are installed entirely above ground.
8.Shade cloth structures constructed for nursery or agricultural purposes, not including service systems.
9.Swings and other playground equipment accessory to detached one- and two-family dwellings.
10.Window awnings in group R-3 and U occupancies, supported by an exterior wall that do not project more than 54 inches from the exterior wall and do not require additional support.
11.Nonfixed and movable fixtures, cases, racks, counters and partitions not over 5 feet 9 inches in height.
12. Recreational equipment, arbors, trellises, and yard features as defined in the Zoning Ordinance and accessory to detached one- and two-family dwellings unless electrical work or a foundation is required for installation.
[A] 107.1 General.
Submittal documents consisting of construction documents, statement of special inspections, geotechnical report and other data shall be submitted in two or more sets with each permit application. The construction documents shall be prepared by a registered design professional where required by the statutes of the jurisdiction in which the project is to be constructed, or when required by the building official. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional.
Exception: The building official is authorized to waive the submission of construction documents and other data not required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that review of construction documents is not necessary to obtain compliance with this code.
[A] 107.2.5.1 Design Flood Elevations.
Where design flood elevations are not specified, they shall be established in accordance with section 1612.3.1 and title 14 of the Des Plaines city code.
[A] 107.2.5.2 Drainage And Grading Plan Requirement.
A drainage and grading plan prepared by a professional engineer licensed in the state of Illinois shall be submitted with permit applications for the following items: construction of new buildings, additions or alterations to existing buildings that result in a 50% or greater increase in the footprint of the building, grade changes that affect drainage conditions, and any grade changes to properties located within designated flood plain areas. A drainage and grading plan is not required for detached garages.
[A] 107.2.5.3 Foundation Grades And Rules.
The director of public works and engineering shall, from time to time, promulgate detailed rules, including without limitation standards for engineering site plans, not inconsistent with this code, for the purpose of determining foundation grades. Such rules shall become effective when filed in the office of the city clerk and thereafter shall have the same force and effect as an ordinance duly adopted by the corporate authorities of the city of Des Plaines.
[A] 107.2.5.4 Subdivision Grade Plan.
With respect to subdivisions, the drainage and grading plan requirement set forth in section 107.2.5.2 of this code shall be supplemental to the subdivision regulations adopted from time to time by the city of Des Plaines. In the event of a conflict between section 107.2.5.2 of this code and any provision of the subdivision regulations, the subdivision regulations shall control. The building official shall not issue a building permit for such subdivisions unless a lot- grading plan has been approved by the director of public works and engineering.
[A] 109.2.1 Fee Schedule.
The fees charged by the city of Des Plaines for all permits required by this chapter are set forth in chapter 13 of title 10 of the Des Plaines city code.
[A] 109.3.1 Project Valuation.
Building permit valuations for all permits required by this code shall be determined in accordance with chapter 13 of title 10 of the Des Plaines city code.
[A] 110.3.8.1 Spot Survey Required.
A plat of the piece or parcel of land, lot, lots, block, blocks, or parts or portions thereof, drawn to scale showing the actual dimensions of the land parcel, the location of all buildings and improvements, including excavations and foundation walls, and the elevation of the top of the foundation in accordance with the city of Des Plaines benchmark system (North American vertical datum of 1988), and certified by a registered land surveyor licensed in the state of Illinois as a true and correct depiction of the piece or parcel of land, lot, lots, block, blocks, or parts or portions thereof, according to the registered or recorded plat of such land, shall be submitted immediately after the foundation wall(s) have been completed to the building official for review and approval of the foundation elevation and location.
[A] 110.3.8.2 As-Built Survey.
No permanent certificate of occupancy or other indication of approval of new construction shall be issued or given by the building official until an as-built survey of the drainage and grading plan has been approved by the department of public works and engineering.
[A] 110.3.10.2 Digital Final Construction Documents.
When construction documents are produced in a digital format, as-built construction documents shall be submitted on a compact disc or a flash drive in tagged image format (TIF) or in another format approved by the department of public works and engineering.
[A] 111.1 Use And Occupancy.
No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made, until the building official has issued a certificate of occupancy therefor as provided herein. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. A certificate of occupancy shall not be valid until the fees prescribed by chapter 13 of title 10 of the Des Plaines city code have been paid.

[A] 111.1.1 Temporary Certificate Of Occupancy.
When inclement weather has substantially delayed or will substantially delay the completion of a construction project authorized pursuant to a building permit issued by the city, the building official may issue a temporary certificate of occupancy prior to the completion of all site work and landscaping; provided, however, that no temporary certificate of occupancy shall be issued pursuant to this section [A] 111.1.1 unless the building official receives a cash performance security or equivalent performance security in a form approved by the Director of Community and Economic Development in the amount of the actual completion costs, but not less than $5,000.00, on terms acceptable to the Director of Community and Economic Development, to secure the completion of all work.

Exception: Certificates of occupancy are not required for work exempt from permits under section 105.2 or as approved by the building official.
Section 113 Board Of Appeals.
Section 113 is hereby deleted in its entirety.
1612.3 Establishment Of Flood Hazard Areas.
To establish flood hazard areas, the applicable governing authority shall adopt a flood hazard map and supporting data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the federal emergency management agency in an engineering report entitled "The Flood Insurance Study For City Of Des Plaines," dated August 19, 2008, as amended or revised with the accompanying flood insurance rate map (FIRM) and flood boundary and floodway map (FBFM) and related supporting data along with any revisions thereto. The adopted flood hazard map and supporting data are hereby adopted by reference and declared to be part of this section.
3002.4 Elevator Car To Accommodate Ambulance Stretcher.
Where elevators are provided in buildings, at least one elevator shall be provided for fire department emergency access to all floors. The elevator car shall be of such a size and arrangement to accommodate an ambulance stretcher 24 inches by 84 inches with not less than 5-inch radius corners, in the horizontal, open position and shall be identified by the international symbol for emergency medical services (star of life). The symbol shall not be less than 3 inches in height and shall be placed inside on both sides of the hoistway door frame.

[A]3303.1 Demolition Permit - Construction Documents, Performance Security
   A.   Construction Documents and Schedule: Prior to the issuance of a demolition permit, construction documents and a schedule for demolition shall be submitted where required by the Director of Community and Economic Development or their designee.
   B.   Performance Security: In addition to the payment of the applicable permit fees set forth in section 10-13-3 of the Des Plaines City Code, every applicable demolition permit application shall be accompanied by a cash bond in the amount set forth in section 10-13-3 of the Des Plaines City Code, on terms acceptable to the Director of Community and Economic Development, to secure the completion of the following work: filling, grading, and seeding the site so that the site does not allow (i) the accumulation of standing water, except for approved detention or retention, or (ii) the drainage or runoff of storm water to adjoining properties.
   1.   Refund: The cash bond required pursuant to subsection B of this section shall be refunded by the city upon final inspection and approval of the demolition work by the city.
   2.   Forfeiture: The city will notify the property owner and permit holder in writing if (i) the demolition permit has lapsed and the lot is not filled, graded, or seeded in accordance with section 3303.4 of this code or the National Pollutant Discharge Elimination System (NPDES) permit, if applicable, or (ii) the work performed pursuant to the demolition permit otherwise violates this code. If the property is not brought into compliance with this section within 30 days after such notice is sent, then the cash bond required pursuant to subsection B of this section shall be deemed forfeited to the city. The city may, but is not obligated to, use the forfeited funds to fill, grade, and/or seed the demolition site in accordance with this section.

[A]3303.4 Vacant Lot
Where a structure has been demolished or removed, the vacant lot shall be filled and maintained to the existing grade and seeded with grass seed.

3412.2 Applicability.
Structures existing prior to January 16, 1939, in which there is work involving additions, alterations or changes of occupancy shall be made to comply with the requirements of this section or the provisions of sections 3403 through 3409. The provisions in sections 3412.2.1 through 3412.2.5 shall apply to existing occupancies that will continue to be, or are proposed to be, in groups A, B, E, F, M, R, S and U. These provisions shall not apply to buildings with occupancies in group H or I.
