Nonconforming uses and nonconforming structures may be located on public school and public school district property as special school uses regardless of whether those uses and structures are conditional uses under the city of Des Plaines zoning code, upon a determination of the city council on a case by case basis, based upon, but not limited to, the following criteria:
A. The proposed special school use has some direct benefit to the school and/or school district.
B. The proposed special school use is designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity.
C. The proposed special school use is not hazardous or disturbing to existing neighboring uses or to the city's 9-1-1 emergency communications' frequencies.
D. The proposed special school use does not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any property or the general public welfare.
E. The proposed special school use complies with all applicable regulations of the city's building code and permitting requirements of the city. (Ord. M-52-03, 8-18-2003)
