8-6-3: PLANT AND FENCE RESTRICTIONS:
It shall be unlawful for an adjoining property owner, or occupant thereof, to cause or allow bushes or other dense plantings to grow in excess of twenty four inches (24") in height within a parkway or within eight feet (8') back of the property line of such property, or to construct or maintain a fence in a parkway. Nothing in this section shall be construed to be permission to construct a fence of any size in a parkway where otherwise prohibited by the building code, fence ordinance or other law or regulation, and this section is expressly made subject and subordinate to such other provisions.
Notwithstanding the foregoing, in the C-1, C-2, C-3 and C-4 zoning districts, it shall be unlawful for an adjoining property owner, or occupant thereof, to cause or allow any bushes or other dense plantings to grow in excess of twenty four inches (24") in height within a parkway or within eight feet (8') back of the property line of such property.
The acts prohibited by this section are hereby declared to be a nuisance and a traffic hazard, in that they obstruct the clear view of motorists, cyclists and pedestrians traveling on adjoining streets and sidewalks.
The director of public works shall be and is authorized to cause the removal of such obstructions immediately upon detection. (Ord. M-25-92, 7-6-1992)
