7-11-1: ELIGIBILITY FOR SEIZURE AND IMPOUNDMENT:
A motor vehicle, operated with the permission, express or implied, of the owner of record, that is used in connection with the following violations, may be subject to seizure and impoundment by the city, and the owner of record of said vehicle shall be liable to the city for an administrative penalty in an amount not to exceed five hundred dollars ($500.00), if the vehicle is subject to seizure under current state law, the vehicle creates a danger to public safety or the efficient movement of traffic, or the vehicle must be moved from an exposed public location for public convenience. In addition to any fine imposed, the owner of record shall also be liable for any towing and storage fees as hereinafter provided. (Ord. M-6-12, 3-5-2012)
   A.   Driving while driver's license, permit, or privilege to operate a motor vehicle is suspended or revoked, 625 Illinois Compiled Statutes 5/6-303 et seq., pursuant to the secretary of state actions for the following:
      1.   Mandatory revocation.
      2.   Discretionary revocation.
      3.   Discretionary suspension.
      4.   Parking ticket/tollway suspension.
      5.   Failure to appear suspension.
      6.   Statutory summary suspension.
      7.   Zero tolerance suspension.
   B.   Driving under the influence of alcohol, drugs and/or intoxicating compounds or any combination thereof, 625 Illinois Compiled Statutes 5/11-501 et seq.
   C.   Fleeing or attempting to elude a peace officer, 625 Illinois Compiled Statutes 5/11-204 et seq.
   D.   Aggravated fleeing or attempting to elude a peace officer, 625 Illinois Compiled Statutes 5/11-204.1 et seq.
   E.   Reckless driving, 625 Illinois Compiled Statutes 5/11-503 et seq.
   F.   Street racing, 625 Illinois Compiled Statutes 5/11-506 et seq.
   G.   Sex offenses, 720 Illinois Compiled Statutes 5/11-1 et seq.
   H.   Mob action, 720 Illinois Compiled Statutes 5/25-1 et seq.
   I.   Firearm offenses to include:
      1.   Unlawful use of weapons, 720 Illinois Compiled Statutes 5/24-1 et seq.
      2.   Aggravated discharge of a firearm, 720 Illinois Compiled Statutes 5/24-1.2 et seq.
      3.   Aggravated discharge of a machine gun or a firearm equipped with a device designed or used for silencing the report of a firearm, 720 Illinois Compiled Statutes 5/24-1.2-5 et seq.
      4.   Reckless discharge of a firearm, 720 Illinois Compiled Statutes 5/24-1.5 et seq.
      5.   Aggravated unlawful use of a weapon, 720 Illinois Compiled Statutes 5/24-1.6 et seq.
   J.   Possession of cannabis more than thirty grams (30g), 720 Illinois Compiled Statutes 550/4(d), (e), (f), and (g) et seq.
   K.   Illinois controlled substances act, 720 Illinois Compiled Statutes 570/100 et seq. (Ord. M-2-07, 1-16-2007)
   L.   No valid driver's license, no valid driver's license - never issued and no valid driver's license - expired more than twelve (12) months (an exception hereto is no valid driver's license - expired less than 12 months and person less than 17 years of age operating a motor vehicle in violation of child curfew act - no tow), 625 Illinois Compiled Statutes 5/6-101(a) et seq.
