5-2-4: RECEPTACLES:
For the proper and economical separation and collection of the classes of waste hereinbefore defined as "garbage", "refuse", "recyclable materials" and "yard waste", it shall be the duty of every owner, or the occupant of any building where persons reside, board, lodge or conduct business of any kind whatsoever, or where animal or vegetable food is prepared or served, to provide for the building, and at all times to maintain in good order and repair, a separate receptacle for all solid waste, yard waste, and recyclable materials of the capacity, kind and number as prescribed by this chapter, as follows:
   A.   Houses, Stores, Apartments: For each house or building, including store buildings, other than multiple-family dwellings, one or more receptacles for solid waste and one or more receptacles for recyclable materials of a capacity sufficient to contain the accumulations of such waste for a period of at least seven (7) days. For every multiple-family dwelling, one of each such receptacles for each floor, flat or apartment of the building.
   B.   Duty Of Occupant: It shall be the duty of each occupant to cause all solid waste, recyclable materials, and yard waste produced to dispose of said solid waste, recyclable materials, and yard waste in a sanitary manner and in accordance with rules set forth by the department of public works.
   C.   Waste To Be Securely Stored: Solid waste and yard waste of every character whatsoever shall be securely prepared or contained in such manner as to prevent the blowing of the same by the wind and shall be deposited in the receptacles for said materials.
   D.   Waste Containers: The city's waste collection franchisee shall furnish single-family dwellings, with one wheeled cart of thirty five (35), sixty five (65) or ninety five (95) gallon capacity for the purpose of storing solid waste. The city's waste collection franchisee shall furnish multiple-family dwellings with up to four (4) units with one wheeled cart of thirty five (35), sixty five (65) or ninety five (95) gallon capacity per dwelling unit for the purpose of storing solid waste. There is no limit on the number of carts that may be used by residences serviced under the city's waste collection franchise agreement. Residents who request more than one solid waste cart may lease additional carts from the franchisee for a monthly fee. Additional cart leases will be billed directly from the franchisee to the resident.
   E.   Receptacles For Recyclable Materials: The city's waste collection franchisee shall furnish single-family dwellings, with one wheeled cart of thirty five (35), sixty five (65) or ninety five (95) gallon capacity for the purpose to store and collect recyclable materials. The city's waste collection franchisee shall furnish multiple-family dwellings with up to four (4) units, with one wheeled cart of thirty five (35), sixty five (65) or ninety five (95) gallon capacity per dwelling unit for the purpose to store and collect recyclable materials. Said carts will be made of waterproof material with handles, wheels, and a tightfitted lid and shall be no larger than thirty five (35), sixty five (65), or ninety five (95) gallons in capacity. Recyclable materials must be in appropriate carts for collections. There is no limit on the number of carts that may be used by residences serviced under the city's waste collection franchise agreement. Residents who request more than one cart for recyclable materials may lease additional carts through the franchisee for a monthly fee.
