4-15-3: OPERATING PERMIT REQUIREMENTS:
   A.   Permit Required: Within the jurisdiction of this chapter, no land or premises shall be occupied or shall continue to be occupied by two (2) or more mobile homes, which are used by tourists, transients or other persons for sleeping or dwelling purposes, herein termed a mobile home park, unless the park complies with the requirements of this chapter and unless the operating permit has been issued therefor by the city manager and has not been revoked, all as provided herein.
   B.   Application For Permit: Each application for an operating permit shall be made on forms provided by the director of community and economic development and which shall be filed with the director. Among other things, the application shall describe the site, buildings and facilities of the mobile home park in sufficient detail and accuracy so that upon investigation their compliance with the provisions hereof may be judged.
   C.   Annual Operating Permits: The following rules apply for operating permits required herein:
      1.   A permit to operate a mobile home park for the city's fiscal year shall be issued promptly when an application therefor has been and is in proper form and the mobile home park is found to be in compliance with the requirements of this chapter.
      2.   A permit is not transferable and is renewable upon application if the mobile home park is found to be still in compliance with this chapter.
      3.   The annual fee for subject permit shall be set forth in section 4-18-1 of this title.
      4.   Each mobile home existing upon the adoption date of this chapter, or located in an area annexed to the city after the adoption date of this chapter, for which an application for a permit has been made in proper form, that is found to be not in compliance with this chapter shall be entitled to a temporary operating permit and a reasonable time within which to comply with each of the requirements involved.
      5.   The permit shall be conspicuously displayed in the office of the park manager.
      6.   A permit may be revoked or suspended for violation of any provision of this chapter but only after notice has been given the park manager and owner or lessee of the park premises setting forth in writing the violation and time allowed for abatement thereof. (Ord. M-19-13, 10-7-2013)
