4-8-2: LICENSE REQUIREMENTS:
   A.   License Required: No person shall engage in the business of pawnbroker or secondhand dealer within the city without a license. A person simultaneously engaged in the business of both pawnbroker and secondhand dealer is exempt from obtaining a secondhand dealer license so long as that person maintains a valid and effective pawnbroker's license.    B.   Applications For License: Applications for a pawnbroker's or secondhand dealer's license shall be made in conformity with the general requirements of this code relating to applications for licenses.
   C.   Fee: The license fees are set forth in section 4-18-1 of this title.
   D.   Eligibility For License: To be eligible for a pawnbroker's license or a secondhand dealer's license, an applicant must:
      1.   Not have been convicted of a felony within the last ten (10) years and not be acting as a beneficial owner for someone who has been convicted of a felony within the last ten (10) years; and
      2.   Not have been convicted, and not be acting as a beneficial owner for someone who has been convicted of, pled guilty to or been found guilty by a court of law of a criminal offense or ordinance violation that the city finds directly relates to the duties and responsibilities of the pawnbroker or secondhand dealer within the last ten (10) years.
If the applicant for a pawnbroker's license or a secondhand dealer's license is not an individual, the eligibility requirements of this chapter apply to each operator of the business seeking to be licensed and to each direct or beneficial owner of at least ten percent (10%) of the outstanding equity interest of the business seeking to be licensed and if the applicant is a corporation, to each officer and director of the corporation.
   E.   Investigations: The chief of police shall make or cause to be made such investigation as he deems necessary to determine whether the applicant is qualified to engage in business as a pawnbroker or secondhand dealer. No license shall be issued to any applicant who does not comply with the applicable requirements of this code. The chief of police shall indicate on the application for a license the result of his investigation and his recommendation to approve or deny said application. (Ord. M-19-13, 10-7-2013)
