4-6-3: LICENSE REQUIRED:
   A.   Requirements:
      1.   Any person licensed as a firearms dealer, pursuant to federal law, at a business premises located within the city, engaged in retail sales of firearms or ammunition, shall apply for and obtain a city firearms dealer's license pursuant to this chapter by January 1, 1995. A Des Plaines firearms dealer's license shall be required in addition to any other license required by law.
      2.   Any person who becomes a federally licensed firearms dealer after January 1, 1995, or who is currently a federally licensed firearms dealer and is required under this chapter to obtain a Des Plaines firearms dealer's license, shall apply for such license within forty five (45) days of receipt of the federal firearms dealer's license or by January 3, 1995, whichever is sooner.
      3.   Any person licensed under federal law at more than one location within the city must obtain a Des Plaines license for each individual location. A separate application and license fee is required for each location.
   B.   License Fee: The license fees for a Des Plaines firearms dealer's license are set forth in section 4-18-1 of this title.
   C.   License Application; Issuance:
      1.   Application: All applications for a license under this chapter shall be made in writing to the city manager or his designee on a form provided for that purpose. In addition to any other information required by the director, each application for a license shall contain:
         a.   The applicant's full name, residence and address and telephone number where the person is engaged in the business of dealing in firearms;
         b.   If the applicant is a corporation, the corporate name, business and principal place of business of the applicant; the date and state of incorporation; and the names and residence addresses of the corporate officers and its registered agent;
         c.   If the applicant is a partnership, the name and business address and telephone number of the principal office or place of business; the names, addresses and telephone numbers of all partners; the name, address and telephone number of a person authorized to receive notices issued pursuant to this chapter;
         d.   If the applicant is a limited liability company, the name and business address and telephone number of the principal office or place of business; the names, addresses and telephone numbers of all managers and members; the name, address and telephone number of a person authorized to receive notices issued pursuant to this chapter; and
         e.   Fingerprints of owners and other background information shall be required in the form and to the extent set forth in the rules, definitions and regulations promulgated pursuant to section 4-6-4 of this chapter.
      2.   Federal And State Requirements: The city manager or his designee shall not issue a Des Plaines firearms dealer's license to any person who fails to provide proof of a valid federal firearms dealer's license and a valid firearm owner's identification card issued by the state of Illinois.
      3.   Location: The city manager and his designee shall not issue a Des Plaines firearms dealer's license to any person who is engaged in the business of dealing in firearms or any other activity requiring a federal firearms dealer's license, or indicates an intention to do so, within one-fourth (0.25) mile of the grounds of a school or public park, measured from the property lines of the respective properties. Firearms dealer's licenses shall only be issued for permanent places of business and shall not be issued for temporary sales events.
      4.   Grandfather Clause: The restriction on location contained in subsection C3 of this section shall not apply to any person who on September 1, 1994, is engaged in the business of dealing in firearms or firearms ammunition within one-fourth (0.25) mile of the grounds of a school or public park, measured from the property lines of the respective properties.
