4-4-7: APPLICATION FOR LICENSE:
   A.   Contents Of Application: An applicant for license shall submit an application, under oath, stating:
      1.   Applicant's name and residence address.
      2.   Applicant's place of birth, and if a naturalized citizen, the time and place of naturalization.
      3.   The applicant, manager, on site supervisor and bartenders have never been convicted of, pled guilty to, or been found guilty by a court of law of a felony or an offense involving moral turpitude.
      4.   The location where applicant proposes to sell retail alcoholic liquors.
      5.   The proposed location is not within one hundred feet (100') of any church, school, hospital, home for the aged or indigent persons or for veterans, their spouses or children, or any military or naval station. In the case of a church, the distance of one hundred feet (100') shall be measured to the nearest part of any building used for worship services or education programs and not to property boundaries.
      6.   He will not violate any of the provisions of this code or the laws of the state or the United States in the conduct of his place of business.
      7.   In case of a partnership or corporation, the information required by this section shall be furnished as to each partner of a partnership and the principal officers and the owners of five percent (5%) or more of the stock of the corporation.
      8.   The applicant, manager, on site supervisor, and bartenders have never been convicted of, pled guilty to, or been found guilty by a court of law of pandering or other crime or misdemeanor opposed to decency and morality.
      9.   The applicant, manager, on site supervisor and bartenders have never been convicted of, pled guilty to, or been found guilty by a court of law of being the keeper and that the applicant, manager, on site supervisor, and bartenders are not now the keepers of a house of ill fame.
      10.   The name of the owner of the real estate whereon the premises is located, and, if the owner is a trustee of a land trust, then the identity of each beneficiary of the land trust by name and address and a definition of the interest of each beneficiary therein. A certified copy of the land trust agreement shall be filed. A certified copy of the document stating the applicant's possessory interest in the premises shall also be filed.
   B.   Corporations: No corporation shall be issued a liquor license if any stockholder owning five percent (5%) or more of the stock is not a citizen of the United States.
   C.   Time Limit: No application for any liquor license for one location may be filed within one year after denial of any liquor license application for the same applicant at the same location. However, if a new applicant files an application for a liquor license for a location wherein a previous application had been denied to another applicant within one year prior thereto, then upon a two-thirds (2/3) vote of the city council said application shall be referred to the legal and licensing committee for a hearing.
